WHEREAS, the City of South Bend and Gerald D. Hines Interests <br />have negotiated a form of Development Management Agreement setting <br />forth the respective obligations of the parties to accomplish these <br />purposes. <br />WHEREAS, it is now advisable to authorize the execution of <br />said Development Management Agreement between the City of South Bend, <br />Indiana, and Gerald D. Hines Interests. <br />NOW, THEREFORE, BE IT RESOLVED by the Common Council of the <br />City of South Bend, Indiana: <br />SECTION I. The proposed Development Management Agreement, <br />attached hereto as Exhibit A, is hereby approved, and the Board of <br />Public Works, the Mayor, and the City Clerk, are hereby authorized <br />to execute the Agreement on behalf of the City. <br />SECTION II.
