Substitute Bill No. 66 -16 <br />ORDINANCE NO. <br />AN ORDINANCE OF THE COMMON COUNCIL OF THE <br />CITY OF SOUTH BEND, INDIANA AMENDING VARIOUS <br />SECTIONS OF THE SOUTH BEND MUNICIPAL CODE AT <br />CHAPTER 17, ARTICLES 4 AND 6 TO ADDRESS <br />NEW WATER RATES AND CHARGES <br />STATEMENT OF PURPOSE AND INTENT <br />The City of South Bend owns and operates a water utility and this Council has caused to <br />be prepared a study which recommends new water rates and charges. Per the recommendations of <br />this study, the City has determined that water rates and charges should be increased per the revised <br />rates set forth herein, and those should become the new water rates and charges, subject to approval <br />of the Indiana Utility Regulatory Commission ( "IURC "). This Ordinance also reinserts former <br />Article 6 of Municipal Code Chapter 17 covering a water service charge to be used for repair or <br />replacement of leaking water service lines. These provisions which were previously, inadvertently <br />deleted, are codified at their former location within the Municipal Code, i.e., Chapter 17, Article <br />6, Sections 17 -44 through 17 -49. This reinserted Article 6 may also be subject to IURC approval. <br />NOW, THEREFORE, BE IT ORDAINED by the Common Council of the City of South <br />SECTION I. Chapter 17, Article 4, Section 17 -45 of the South Bend Municipal Code <br />shall be amended to read in its entirety as follows: <br />Sec. 17 -45. Water Works rates and charges. <br />There shall be and are hereby established for the use of and the services rendered by the Water <br />Works System of the City of South Bend, the following rates and charges, based upon the use of <br />water and facilities furnished by said Water Works System: <br />(a) Usage per Monthly Rate per <br />Billing Period 100 Cubic Feet <br />(upon effective date,) <br />First 500 cubic feet ..... $1.716 2.094 <br />Next 1,500 cubic feet .....490 1.818 <br />Next 5,500 cubic feet .....1� 1.598 <br />Next 22,500 cubic feet .....1� 1.407 <br />Next 90,000 cubic feet .....0.905 1.104 <br />Rate per 100 Cubic Feet <br />(12 months after effective date) <br />2.554 <br />2.218 <br />1.950 <br />1.716 <br />1.347 <br />
