The height, area, and design variances requested will promote a consistent <br />development that appropriately transitions to ensure compatibility with surrounding <br />development and uses. <br />(2) The use and value of the area adjacent to the property included in the variance <br />will not be affected in a substantially adverse manner; <br />The proposed variances are designed to allow the development to continue in a manner <br />consistent with Eddy Street Commons, Phase I. By limiting the massing of the building <br />facades adjacent to the east property line and using single family townhomes on the west, <br />surrounding property values should not be adversely affected. <br />(3) The strict application of the terms of this Chapter would result in practical <br />difficulties in the use of the property <br />The North East Neighborhood Overlay District was established after the first phase of <br />Eddy Street Commons was completed. Strict application would prevent the development <br />from having a consistent design throughout the development, as well as create difficulties <br />in overall property management and long term maintenance due to the inconsistencies that <br />would result. <br />Staff Comments: <br />Staff has no additional comments. <br />Recommendation: <br />Based on information available prior to the public hearing, the staff recommends the <br />rezoning petition and Special Exception Use be sent to the Common Council with <br />favorable recommendations. The staff recommends that the height variance (variance #4) <br />be to limited to Blocks A and B. The staff recommends approval of all other variances as <br />presented. <br />Analysis: <br />Rezoning the property to MU Mixed Use will allow for the development of the second <br />phase of Eddy Street Commons which will provide a mixed -use development that <br />compliments and supports the existing development and surrounding neighborhood. <br />APC # 2808 -16 Page 5 of 5 <br />
