In accordance with Section 17-4 of the Code of Ordinances of the City of South Bend — (Sec. 17-4 Drains <br />and downspouts disconnection requirements, limited exceptions), and with the City's Downspout <br />exemption policy that was subsequently established and approved, the below listed property has been <br />deemed exempt from the requirement to disconnect its downspouts from the City's sewer system. Please <br />see the downspout disconnection exemption application attached hereto for further information. <br />Property Address: <br />237 North Michigan Street <br />South Bend, <br />Indiana, <br />4661-46061 <br />In summary, the reason for this exemption is as follows: <br />• Disconnections are not technically feasible - downspouts are internal to the building and <br />connect to an underground drainage system; <br />• The building is registered heritage structure and redirecting the drainage system will harm <br />its architectural finish; <br />• Financial hardship - the scope of work is estimated to cost $300,000 at a minimum, which <br />doesn't include historical re -work costs. <br />Please see the attached photos. <br />An exemption issued may be revoked where any information provided in the application or in support of <br />the application by the property owner(s) or any person on his or her behalf is false, misleading or <br />inaccurate in whole or part. <br />The City reserves the right to revise the application form or the exemption process from time to time. The <br />City reserves the right to amend, modify or revoke the exemption provided under South Bend Code of <br />Ordinance, Chapter 17-4 (C) 1 or 2 as it deems appropriate. <br />
