NEMETH, Mayor <br />COUNTY -CITY BUILDING SOUTH BEND, INDIANA 46601 <br />EPARTMENT OF HUMAN RESOURCES AND ECONOMIC DEVELOPMENT <br />Carl Ellison <br />Director MEMORANDUM <br />TO : Member of the Common Council <br />FROM : Carl Ellison dtd Uo�' <br />SUBJECT: City Employee /Public Official <br />Participation in HUD - funded programs <br />DATE : August 21, 1979 <br />1200 County -City Building <br />South Bend, IN 46601 <br />(219) 284 -9371 <br />The City's grant agreements with HUD require that no city <br />employee, elected official, or other public official "shall have <br />any interest, direct or indirect, in any contract or subcontract, <br />or the proceeds thereof, with respect to which assistance is <br />provided." Because of this provision, the Community Development <br />Program has in the past requested written waiver of this provision <br />from HUD on a case -by -case basis when a city employee or public <br />official made application and was determined to be otherwise <br />eligible to participate in a HUD - funded activity. HUD has responded <br />favorably to every request. <br />However, HUD now advises us that waivers will be granted on <br />the condition that the Common Council publically recognize the <br />participation of city employees or public officials in HUD - funded <br />programs.
