A RESOLUTION CONFIRMING THE ADOPTION OF A DECLARATORY
RESOLUTION DESIGNATING CERTAIN AREAS WITHIN THE CITY OF
SOUTH BEND, INDIANA, COMMONLY KNOWN AS
A Vacant Lot Between 1016 and 1032 West Washington Street
AS RESIDENTIALLY DISTRESSED AREAS FOR PURPOSES OF A
(5) FIVE-YEAR RESIDENTIAL REAL PROPERTY
TAB ABATEMENT FOR
South Bend Heritage Foundation, Incorporated
WHEREAS, the Common Council of the City of South Bend, Indiana, has adopted a
Declaratory Resolution designating certain areas within the City as Residentially Distressed
Areas for the purpose of tax abatement consideration; and
WHEREAS, a Declaratory Resolution designated the area commonly known as the
vacant lot between 1016 and 1032 West Washington Street, South Bend, Indiana, and which is
more particularly described as follows:
A tract of land 120.78 feet, East and West, by 144.64 feet, North and South,
located in the Northwest corner of Bank Out Lot Numbered Eighty-nine (89) on
the second Plat of Out Lots to the Town, now City of South Bend, platted by the
State Bank of Indiana. (In the process of being replatted into two equal lots -Lots
# 1 and #2 of Washington Street Minor Subdivision.)
and this property has Tax Key Number 18-3068-2608, be designated as a Residentially
Distressed Area under the provisions of Indiana Code 6-1.1-12.1 et sea., and South Bend
Municipal Code Sections 2-76 et seQ., and;
WHEREAS, notice of the adoption of a Declaratory Resolution and the public hearing
before the Council has been published pursuant to Indiana Code 6-1.1-12.1-2.5; and
WHEREAS, the Council held a public hearing for the purposes of hearing all
remonstrances and objections from interested persons; and
WHEREAS, the Council has determined that the qualifications for a residentially
distressed area have been met.
NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of South
Bend, Indiana, as follows:
SECTION I. The Common Council hereby determines and finds that the petition for real
property tax abatement and the Statement of Benefits form meet the requirements of Indiana
Code 6-1.1-12.1 et sea., for tax abatement.
SECTION II. The Common Council hereby determines and finds that the area meets one of the
following conditions as formally established in Ordinance No. 9394-03, which was passed on
February 10, 2003:
A. The area is comprised of parcels that are either unimproved or contain only one (1)
or two (2) family dwellings designed for up to four (4) families, including accessory
buildings for those dwellings; or
B. Any dwellings in the area are not permanently occupied and are:
i. the subject of an order issued under IC 36-7-9; or
ii. evidencing significant building deficiencies; or
C. Parcels of property in the area:
i. have been sold and not redeemed under IC 6-1.1-24 and IC 6-1.1-25; or
ii. are owned by a unit of local government; or
D. A significant number of dwelling units within the area are not permanently
occupied or a significant number of parcels in the area are vacant land; or
E. A significant number of dwelling units within the area are:
i. the subject of an order issued under IC 36-7-9; or
ii. evidencing significant building deficiencies; or
F. The area has experienced a net loss in the number of dwelling units, as documented
by census information, local building and demolition permits, or certificates of
occupancy, or the areas are owned by Indiana or the United States; or
G. The area (plus any areas previously designated under this subsection) will not
exceed ten percent (10%) of the total area within the Council's jurisdiction.
SECTION III. The Common Council also hereby determines and finds the following:
A. That the description of the proposed redevelopment meets the applicable standards
for such development.
B. That the estimate of the value of the redevelopment is reasonable for projects of this
nature;
C. That the other benefits about which information was requested are benefits that can
be reasonably expected to result from the proposed described redevelopment; and
D. That the totality of benefits is sufficient to justify the requested deduction, all of
which satisfy the requirements of Indiana Code 6-1.1-12.1-3.
E. The deduction will not be allowed unless the dwelling is rehabilitated to meet local
code standards for habitability.

F. The deduction will not be allowed unless the dwelling rehabilitation is completed
within five (5) calendar years from the date of the adoption of this Resolution by the
Common Council.
SECTION IV. The Common Council hereby confirms its Declaratory Resolution designating
the area described herein as a Residentially Distressed Area for the purposes of tax abatement.
Such designation is for Real property tax abatement only and is limited to five (5) calendar years
from the date of adoption of the Declaratory Resolution by the Common Council.
SECTION V. The Common Council hereby determines that the property owner is qualified for
and is granted Real property tax deduction for a period of five (5) years, and further determines
that the petition complies with Chapter 2, Article 6, of the Municipal Code of the City of South
Bend and Indiana Code 6-1.1-12.1 et sea.
SECTION VI. This Resolution shall be in full force and effect from and after its adoption by the
Common Council and approval by the Mayor.

Please find attached the Department of Community & Economic Development's report on a residential
real property tax abatement petition submitted by the South Bend Heritage Foundation, Inc. to build two
single-family homes on a vacant lot located between 1016 and 1032 West Washington Street. The lot is
in the process of being replatted to hold the two homes. Also attached is a copy of the petition,
Statement of Benefits form, and supporting information.
The report contains the department's findings relative to the above petition. The petitioner proposes to
build two single-family homes at a cost of approximately $180,000 each. The project meets the
qualifications fora (5) five-year real property tax abatement. The petitioner will be available to meet
with the Committee on Monday, September 28, 2008.

On September 11, 2009, a petition for residential tax abatement consideration for real property located on a
vacant lot between 1016 and 1032 West Washington Street was filed with the City Clerk by the South Bend
Heritage Foundation, Incorporated. Pursuant to Chapter 2, Article 6, Section 2-77.1 of the Municipal Code
of the City of South Bend, this petition was referred to the Department of Community and Economic
Development for purposes of investigation and preparation of a report determining whether the area
qualifies as a Residentially Distressed Area pursuant to I.C.6-1.1-12.1 and whether all zoning requirements
have been met.
The Department of Community and Economic Development has reviewed the petition (a copy of which is
attached), investigated the area, and makes the following report.
PROJECT DESCRIPTION
The South Bend Heritage Foundation, Inc. intends to construct two new single-family homes on the vacant
lot they currently own on West Washington Street. The lot is being replatted to permit the construction of
the two homes. The homes will each have two stories totaling approximately 1,700 square feet with three
bedrooms. The average cost of the two homes will be approximately $180,000. The two homes are part of
the first allocation of the Neighborhood Stimulus Program (NSP) funding. Several single-family homes
will be built in targeted areas to serve homeowners with a household income of up to 120% of the Area
Median Income using NSP funds. The sales prices of the two homes will be discounted in order to make
them affordable to these potential customers. South Bend Heritage will be the developer of several of these
houses.

$16,827.76. Total taxes to be aid for the two houses during the (5) five-year abatement period are

The petitioner is in compliance with the reporting requirements for the previous abatements.
2. The Building Commissioner has reviewed this petition and finds the property to be properly zoned for
the proposed project.
3. A review of the South Bend Redevelopment designation areas finds that the property is located in the
West Washington/Chapin Development Area, which is a Tax Incremental Allocation Area; therefore,
approval of the tax abatement petition by the South Bend Redevelopment Commission is required.
4. A review of the Tax Abatement Ordinance No. 9394-03 finds that the petitioner meets the
qualifications fora (5) five-year residential tax abatement under Section 2-77.1, .Single Family
Residential Construction.

Section 2: Description of real property, improvements, redevelopment or rehabilitation:
A vacant lot on W. Washington with 120 + feet of street frontage will be replatted into two lots (Lot 1
and Lot 2 of Washington Street Minor Subdivision), each with 60 + feet of street frontage . Two
approximately 1,700 square foot, two-story, three bedroom houses will be built on these lots, starting
with Lot 2.
Section 5: Other Benefits.
The beneficiaries of these houses will be single family, owner occupants that have a family income of
120% of the Area Median Income, or less. The sales price will be discounted by approximately $40-
50,000 in order to be affordable to these potential owners. This opportunity to provide affordable
housing through granting a discount is a direct result of the NSP (Neighborhood Stimulus Program)
monies allocated by the Federal Government to South Bend.

PETITION FOR RESIDENTIAL TAX ABATEMENT CONSIDERATION
The undersigned owner(s) of real property, located within the City of South Bend, hereby petition the Common
Council of the City of South Bend for Residential Real Property tax abatement consideration and pursuant to I.C.. 6-
1.1-12.1-1, et seq~ and South Bend Municipal Code Sec. 2-76 et se .for this petition states the following:
1. Describe the proposed construction project, including information about square footage, numbers of rooms,
amenities, the amount of land to be used, the proposed use of the improvements, and a general statement as to
the importance of the project (use additional sheet for long project descriptions):
South Bend Heritage Foundation (a community development corporation formed in 1974 to work on the stabilization
and revitalization of the near west side neighborhoods of South Bend) owns a lot between 1016 and 1032 W. Washington
which Is approximately 17A58 square feet (or .0.40 acres). The frontage along West Washington is 120.78 feet. A
proposed replat will divide it into two lots each with approximately 8.729 square feet (or 0.20 acres) and a frontage along
West Washington of slightly over 60 feet (see Washington Street Minor Subdivision survey for the proposed replat
provided with Exhibit B).
As part of the first allocation of the Neighborhood Stimulus Program (NSPI funding, several single-family houses will
be built in targeted areas to serve homeowners with a household income of up to 120% of the Area Median Income.
South Bend Heritage Foundation (SBHF) will be the developer of several of these houses.
The two houses that will ultimately built on these lots will be two story. three bedroom homes of approximately 1,700
square feet. The first will be built on Lot 2 of the new Subdivision. The beneficiaries of these houses will be single
family. owner occupants that have a family income of 120°l0 of the Area Median Income, or less
The sales price will be discounted in order to be affordable to these potential owners. This opportunity to provide
affordable housing is a direct result of the NSP funds allocated by the Federal Government to South Bend. Receiving
tax abatement on the property will help the families adiust fmancially to homeownership and to budget for the increase
in the property tax in five years time.
SBHF strongly believes that a key component to stabilizing neighborhoods is encouraging residents of mixed incomes to
live there. By providing affordable options on W. Washington where its housing stock of large homes is gradually being
converted back to single family. the goal of mixed income residents can be achieved as can increased stability. SBHF
firmly believes that constructing affordable housing on these two new lots help achieve_the national goals set out in the
Federal NSP initiative.

11. No building permit has been issued for construction on the property in connection with the improvement in
question as of the date of filing of this petition. The building permit maybe issued after the South Bend
Common Council has approved the Declaratory Resolution. (Tax abatement is not available if a building permit
has already been issued). The signature below is verification of this statement.
12. List other anticipated public financing for the project, including any assistance to be sought or already authorized
through the United States Department of Housing and Urban Development funds from the City of South Bend,
South Bend Housing Authority, Housing Assistance Office, St. Joseph County Housing Consortium or other
public financial assistance, including but not limited to public works improvements:

13. Describe how the property has become undesirable for or impossible of normal development because of a lack of
development, cessation of growth, deterioration of improvements or other factors which have impaired values and
prevent a normal development of the property:
The 1963 edition of the Sandborn Mans of South Bend show no building on this lot but indicated an address of 1026 W.
Washington. Therefore. anv house that may have been on the lot was demolished before 1963. It is located in an area
that experienced severe disinvestment since the 1960s when many of the grand houses were divided into apartments or
used for businesses or demolished. It is close to the infamous "block " at Washington and Walnut where drugs and crime
were on the increase . discouraging anv development and investment. People wanted out. not to move in. It is in the
carne block as the Natatorium and Hansel Center which became. until recently. blights on the block. There was no
development.
By the late 1980s and early 1990x. this scenario started changing with the demolition of the "block" and construction of
affordable duplexes and triplexes (West Washington Homes) and. west of that. new construction of single family. owner
occupied affordable homes. More recently the plans for making the Natatorium into the Civil Rights Heritage Center
are in the process of being implemented and beginning plans for the Hansel Center to be converted into an extension of
Notre Dame's Center for Latino Studies. The climate for development has changed and investment in housing is
increasing gradually in this neighborhood.
14. The current use of the property is vacant lot and the current zoning is SF2 (use).
15. The property is located in the following Allocation Area (if any) declared and confirmed by the South Bend
Redevelopment Commission (requiring approval of the tax abatement by the Redevelopment Commission):
