RESOLUTION NO. 768 -80 <br />A RESOLUTION SETTING FORTH CERTAIN GUIDELINES <br />FOR THE SALARY NEGOTIATIONS BETWEEN THE COMMON <br />COUNCIL AND THE FIREFIGHTERS AND POLICE OFFICERS. <br />WHEREAS, Indiana Code Section 18- 1 -11 -2 authorizes the Common <br />Council to set the annual pay of all police officers and firefighters; <br />and <br />WHEREAS, significant changes in the area of labor negotiations <br />have taken place since the State law was enacted in 1905; and <br />WHEREAS, the Common Council desires to set forth certain guide- <br />lines for the upcoming salary negotiations. <br />NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City <br />of South Bend, Indiana, as follows: <br />SECTION I. The Common Council believes in the concept of <br />collective bargaining when setting salaries for police officers and <br />firefighters. In the interest of formalizing a structure for the <br />upcoming salary negotiations the following guidelines are adopted. <br />SECTION II. Members of the Common Council and their designates <br />shall meet with representatives of the firefighters (sworn members <br />of the department excluding chiefs and battalion chiefs) and their <br />designates, and representatives of the police officers (sworn members <br />of the department excluding chiefs and captain) and their designates <br />respectively, for the purpose of setting salaries for the 1981 calendar <br />year. <br />SECTION III. Salary negotiations shall be initiated by the fire- <br />fighters and police officers respectively by each of them submitting <br />to the Common Council a salary proposal on or before March 31, 1980. <br />Within ten (10) days of the receipt of such proposal(s) the Council <br />shall meet privately with the representatives of the firefighters and <br />police officers respectively to discuss such proposal(s). <br />SECTION IV. In the event that the parties are unable to reach <br />agreement on salaries by the first Monday in June, the parties may <br />submit a request to the Federal Mediation and Conciliation Service <br />for a mediator. Recommendations of the mediator shall be reported <br />back to the full membership of the parties for acceptance, modification, <br />or rejection prior to the last Common Council meeting in July. <br />SECTION V. The Salary ordinances for the firefighters and police <br />officers respectively shall be adopted by the last meeting of the <br />Common Council in July. <br />SECTION VI. This Resolution shall be in full force and effect <br />from and after its adoption by the Comm"ounci and approval by <br />the Mayor. <br />the Common ncil <br />Adopted, as amended, March 24, 1980 <br />
