RESOLUTION NO. <br />A RESOLUTION REQUESTING THAT <br />THE AIR POLLUTION OPERATION <br />PERMIT REQUESTED BY PRENCO, <br />INCORPORATED, BE DENIED. <br />WHEREAS, the Common Council of the City of South Bend, is the <br />elected body which represents the viewpoints of its citizens within the <br />Community; and <br />WHEREAS, the Council recognizes the need to protect the health, <br />safety, and welfare of the Community; and <br />WHEREAS, the City of South Bend, Indiana, and Prenco, Incorporated, <br />a Delaware Corporation entered into an agreement for the maintenance and <br />operation of a Soluble Oil Disposal Facility on December 4, 1978, and the <br />City subsequently terminated said agreement effective September 30, 1980; and <br />WHEREAS, the public outcry by the residents against the proposed <br />new location on the Southwest side of South Bend is as great an outcry as <br />those opposing the Riverside location; <br />WHEREAS, a recent survey indicates that there is no present need <br />for such a soluble oil facility in the area; and <br />WHEREAS, there is a potential danger to the health and safety <br />of our residents by the transporting of such wastes to and from the <br />proposed facility. <br />NOW, THEREFORE, BE IT RESOLVED, by the Common Council of the <br />City of South Bend, Indiana, as follows: <br />SECTION I. The Common Council requests that the Air Pollution <br />Operation Permit requested by Prenco Incorporated to operate at the <br />southwest side of the City be denied. <br />SECTION II. The Council believes that the potential health <br />and safety dangers and the lack of a present need of such a soluble oil <br />disposal facility in the area are justifible public concerns to deny such <br />a permit. <br />SECTION III. This Resolution shall be in full force and effect <br />from and after its adoption by the Common Council and approval by the Mayor. <br />PRESENTED .f"' 42 Y' e o <br />NOT.
