direction along the center line of Crumstown Road a distance of 838 <br />feet to the point of beginning. <br />EXCEPTING THEREFROM the following described property: <br />A tract or parcel of land in the Northeast Quarter of Section No. 4 <br />in Township No. 37 North, Range No. 2 East, situated in the City <br />of South Bend, described as follows, Viz: <br />Beginning in the center of the Crumstown Avenue in said City of <br />South Bend at a point North 64 °3' East, a distance of 1013.7 <br />feet from the center of said Section No. 4; thence due North a <br />distance of 500 feet; thence due West a distance of 720 feet; <br />thence North a distance of 552.32 feet for a place of beginning <br />of the land to be herein described; thence continuing North along <br />the West line of Beacon Heights,as recorded May 5, 1944 in Plat <br />Book 15, page B in the Office of the Recorder of St. Joseph <br />County, Indiana, a distance of 685.58 feet; thence South 89 156' <br />East, a distance of 122.4 feet; thence South 0 002' West a distance <br />of 140.3 feet; thence South 89 158' East a distance of 597.6 feet; <br />thence South a distance of 545.44 feet; thence South 89 049' West <br />a distance of 253.17 feet; thence South a distance of 68.78 feet; <br />thence West a distance of 213.75 feet; thence North a distance <br />of 68.79 feet; thence South 89 149' West, a distance of 253.17 <br />feet to the place of beginning. <br />AND ALSO EXCEPTING THEREFROM other land described as follows: <br />A tract of land located in the Northeast Quarter of Section 4, <br />Township 37 North, Range 2 East, more particularly described <br />as follows: <br />Commencing at a point which is the intersection of the Southerly <br />line of Lincoln Way West and the West line of a right -of -way 19 <br />feet in width as dedicated in the recorded Plat of Alward's <br />Addition to the City of South Bend; thence South along the West <br />line of said 19 foot right -of -way a distance of 633.09 feet to <br />the point of beginning which is the Northeast corner of Beacon <br />Heights Addition; thence continuing South along the West line <br />of said 19 foot right -of -way a distance of 330 feet; thence <br />West along a line at right angles to the line just described a <br />distance of 21 feet; thence North and parallel to said right -of- <br />way a distance of 330 feet; thence East 21 feet to the point of <br />beginning. <br />is an Urban Development Area; and <br />WHEREAS, the Area Plan Commission has submitted to the <br />Council its written order approving for the Declaratory Resolution <br />to the Council; and <br />WHEREAS, notice of the adoption of a Declaratory Resolution <br />and the public hearing before the Council having been published <br />pursuant to Indiana Code 18- 7 -7 -14; and <br />WHEREAS, the Council held a public hearing for the purposes <br />of hearing persons in favor of the proposed project and those <br />remonstrators who were opposed to the proposed project; and <br />WHEREAS, the Council has determined the public utility and <br />benefit of the project. <br />NOW, THEREFORE BE IT RESOLVED by the Common Council of the <br />City of South Bend, Indiana, as follows: <br />-2- <br />
