Kernan <br />CITY of SOUTH BEND <br />RQGER Q PARENT, Mayor <br />COUNTY -CITY BUILDING SOUTH BEND, INDIANA 46601 <br />Common Council <br />County -City Building <br />South Bend, Indiana 46601 <br />Dear Council Members: <br />September 10, 1980 219/284 -9412 <br />The Board of Public Works, at its meeting held on August 25, <br />1980, conducted a public hearing on the petition for a scrap <br />dealer's license of Bremen Iron and Metal Company, Inc. for <br />property located off Sample Street and Prairie Avenue <br />(immediately east of Webster and extending along and to the <br />rear of the Penn Central Railroad tracks). <br />In accordance with Ordinance No. 6621 -79, regarding the licens- <br />ing of scrap dealers, the Board of Public Works, at its meeting <br />held on September 8, 1980, adopted a resolution approving the <br />issuance of a license to Bremen Iron and Metal, subject to <br />approval and ratification by the Common Council, and further <br />subject to the receipt by the Legal Department of a statement <br />that the legal description to which the license would apply <br />would be amended to include only those areas zoned "E" heavy <br />industrial, and that there would be no expansion or encroachment <br />within the 1,000 foot distance, unless that area was previously <br />licensed. <br />This Resolution approving the issuance of the license was adopted by <br />the Board of Public Works because it found Bremen Iron and Metal <br />in technical compliance with the requirements of the South Bend <br />Municipal Code, if the matters mentioned above are complied with. <br />It was the feeling of the Board that it was their function to <br />determine technical compliance; however, other matters were raised <br />by members of the surrounding neighborhood which the Board deter- <br />mined were more appropriate for consideration at the public hear- <br />ing and determination by the Common Council. <br />Therefore, this matter is now being referred to you for public <br />hearing and subsequent action on the petition for a license. <br />Enclosures <br />Sincerely, <br />BOAP F PUBLI/C /ORKS <br />atrick M. cMahon, P.E., President <br />
