RESOLUTION NO. _<6 Q q - �o <br />RESOLUTION OF THE COMMON COUNCIL OF THE <br />CITY OF SOUTH BEND DESIGNATING CERTAIN <br />AREAS WITHIN THE CITY, COMMONLY KNOWN AS <br />2222 W. WASHINGTON, AS AN URBAN DEVELOP- <br />MENT AREA FOR THE PURPOSES OF TAX ABATEMENT <br />CONSIDERATION <br />WHEREAS, a Petition for Real Property Tax Abatement Consid- <br />eration has been filed with the Common Council of the City of South <br />Bend pursuant to Section 2 -76(a) of the Municipal Code requesting <br />that the area commonly known as Merry Avenue Project and which more <br />particularly described by a line drawn as follows: <br />A parcel of land in the Northeast Quarter of Section 10, <br />Township 37 North, Range 2 East, known as Arnold's First <br />Addition (lots 1 -44, Vacated Alleys and Streets) to the <br />City of South Bend, St. Joseph County, Indiana more part- <br />icularly described as follows: <br />Beginning at the intersection of the West right -of -way <br />line of Grant Street and the South line of West Washington <br />Avenue; thence S 0° 03' 08" W a distance of 514.92 feet to <br />the intersection of the North right -of -way line of the Penn <br />Central Railroad; thence N 64° 39' 26" W on and along the <br />North right -of -way line of said ralroad a distance of 1194.77 <br />feet to the intersection of the North right -of -way line of <br />said railroad and the East right -of -way line of Olive Street; <br />thence N 82° 43' 43" E a distance of 74.33 feet to a point on <br />the South right -of -way line of Washington Avenue West; thence <br />S 890 39' 53" E on and along the South right -of -way of said <br />avenue a distance of 1006.55 feet to the place of beginning <br />containing (283,072 sq. ft.) 6.50 acres more or less subject <br />to all legal easements. <br />EXCEPTING: <br />A parcel of land beginning at a point on the Southeast corner <br />of Lot No. 44 in Arnold's First Addition to the City of South <br />Bend; thence North 514', more or less, to the Northeast <br />corner of Lot No. 1 in said Addition; thence West 200', more <br />or less, to the Northwest corner of Lot No. 5 in said <br />Addition; the South 424', more or less, to the Northwest <br />corner of Lot No. 43 in said Addition; then Southeast a <br />distance of 204.7', more or less, to the place of beginning. <br />be designated as an Urban Development Area under the provisions of <br />Indiana Code 6- 1.1- 11.1 -1 and that the public utility and benefit <br />of the project be determined; and <br />WHEREAS, the Redevelopment Commission has conducted an <br />investigation pursuant to Section 2 -77 of the Municipal Code and <br />prepared a report determining that the area qualifies as an Urban <br />Development Area under Indiana Code 6- 1.1- 12.1 -1 and has further <br />prepared maps and plats showing the boundaries and such other <br />information as required by law of the area in question; and <br />WHEREAS, the Human Resources and Economic Development Committee <br />of the Common Council has reviewed said report and recommended to <br />the Common Council that the area qualifies as an Urban Development <br />Area. <br />
