RESOLUTION NO. RESOLUTION OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND APPROVING THE URBAN RENEWAL PLAN AND THE MAKING OF RELOCATION PAYMENTS FOR THE EAST BANK DEVELOPMENT PROJECT AREA WHEREAS, the City of South Bend Department of Redevelopment (the "Department "), pursuant to the Redevelopment of Cities and Towns Act of 1953, as amended (Indiana Code 18 -7 -7) (the "Act "), has conducted surveys and investigations and has thoroughly studied the area in the City of South Bend, County of St. Joseph, State of Indiana, and designated the area as the "East Bank Development Area" (the "Area "), which Area is more particularly described by a line drawn as follows: A parcel of land being a part of the City of South Bend, Portage Township, St. Joseph County, Indiana and being more particularly described as follows, viz: Beginning at the point of intersection of the North right -of -way line of Sorin Street with the East right - of -way line of Niles Avenue in said City; thence South along said East right -of -way line of Niles Avenue to the centerline of the first fourteen (14) foot alley lying North of Cedar Street and between Niles Avenue and Hill Street; thence East along said centerline, to the centerline of Hill Street, a sixty -six (66) foot right -of -way; thence South, along said Hill Street centerline, to the centerline of Jefferson Boulevard; an eighty -two and one- half.(82.5) foot right -of -way; thence West, along said Jefferson Boulevard centerline to the center of the St. Joseph River; thence in a Northwesterly and Northeasterly direction along the centerline of said River to its intersection with the projected North right -of -way line of said Sorin Street; thence East, along said projection and along said North right -of -way line to the East right -of -way line of Niles Avenue which is the place of beginning. WHEREAS, the Department has made detailed studies of the location, physical condition of structures, land use, environmental influences, and the social, cultural, and economic conditions of the Area and has deter- mined that the Area is a blighted area and that it constitutes a menace to the social and economic interests of the City of South Bend and its inhabitants and it would be of public utility and benefit to acquire real estate in such Area and redevelop the Area under the provisions of the Act; and WHEREAS, the Department approved a Development Plan for the Area dated October 3, 1980, entitled "Development Plan, East Bank Development Area, South Bend, Indiana ", consisting of 24 pages (the "Development Plan "), which plan has been submitted to the Common Council for review and approval; and WHEREAS, the Department has adopted its Declaratory Resolution 626 on October 3, 1980, - designating the Area and approving the Development Plan; and WHEREAS, the Area Plan Commission of St. Joseph County, Indiana, which is the duly- designated and acting official planning body for the City of South Bend, has issued its written order approving said Declara- tory Resolution and the Development Plan, and has certified that said Development Plan conforms to the master plan of development for the City of South Bend; and
