RESOLUTION NO. <br />RESOLUTION OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND <br />APPROVING THE URBAN RENEWAL PLAN AND THE MAKING OF RELOCATION PAYMENTS <br />FOR THE EAST BANK DEVELOPMENT PROJECT AREA <br />WHEREAS, the City of South Bend Department of Redevelopment (the <br />"Department "), pursuant to the Redevelopment of Cities and Towns Act of <br />1953, as amended (Indiana Code 18 -7 -7) (the "Act "), has conducted surveys <br />and investigations and has thoroughly studied the area in the City of <br />South Bend, County of St. Joseph, State of Indiana, and designated the <br />area as the "East Bank Development Area" (the "Area "), which Area is more <br />particularly described by a line drawn as follows: <br />A parcel of land being a part of the City of South Bend, <br />Portage Township, St. Joseph County, Indiana and being <br />more particularly described as follows, viz: <br />Beginning at the point of intersection of the North <br />right -of -way line of Sorin Street with the East right - <br />of -way line of Niles Avenue in said City; thence South <br />along said East right -of -way line of Niles Avenue to <br />the centerline of the first fourteen (14) foot alley <br />lying North of Cedar Street and between Niles Avenue <br />and Hill Street; thence East along said centerline, to <br />the centerline of Hill Street, a sixty -six (66) foot <br />right -of -way; thence South, along said Hill Street <br />centerline, to the centerline of Jefferson Boulevard; <br />an eighty -two and one- half.(82.5) foot right -of -way; <br />thence West, along said Jefferson Boulevard centerline <br />to the center of the St. Joseph River; thence in a <br />Northwesterly and Northeasterly direction along the <br />centerline of said River to its intersection with the <br />projected North right -of -way line of said Sorin Street; <br />thence East, along said projection and along said North <br />right -of -way line to the East right -of -way line of <br />Niles Avenue which is the place of beginning. <br />WHEREAS, the Department has made detailed studies of the location, <br />physical condition of structures, land use, environmental influences, and <br />the social, cultural, and economic conditions of the Area and has deter- <br />mined that the Area is a blighted area and that it constitutes a menace <br />to the social and economic interests of the City of South Bend and its <br />inhabitants and it would be of public utility and benefit to acquire real <br />estate in such Area and redevelop the Area under the provisions of the <br />Act; and <br />WHEREAS, the Department approved a Development Plan for the Area <br />dated October 3, 1980, entitled "Development Plan, East Bank Development <br />Area, South Bend, Indiana ", consisting of 24 pages (the "Development <br />Plan "), which plan has been submitted to the Common Council for review <br />and approval; and <br />WHEREAS, the Department has adopted its Declaratory Resolution 626 <br />on October 3, 1980, - designating the Area and approving the Development <br />Plan; and <br />WHEREAS, the Area Plan Commission of St. Joseph County, Indiana, <br />which is the duly- designated and acting official planning body for the <br />City of South Bend, has issued its written order approving said Declara- <br />tory Resolution and the Development Plan, and has certified that said <br />Development Plan conforms to the master plan of development for the City <br />of South Bend; and <br />
