REGULAR MEETING OCTOBER 26, 2009 <br /> <br /> <br /> INSTALLATION OF CERTAIN <br /> IMPROVEMENTS AND EXTENSIONS TO THE <br /> CITY’S SEWAGE WORKS, THE ISSUANCE <br /> AND SALE OF ADDITIONAL REVENUE <br /> BONDS TO PROVIDE FUNDS FOR THE <br /> PAYMENT OF THE COSTS THEREOF, THE <br /> ISSUANCE AND SALE OF BOND <br /> ANTICIPATION NOTES IN ANTICIPATION OF <br /> THE ISSUANCE AND SALE OF SUCH BONDS <br /> AND THE COLLECTION, SEGREGATION AND <br /> DISTRIBUTION OF THE REVENUES OF SUCH <br /> SEWAGE WORKS AND OTHER RELATED <br /> MATTERS” <br /> <br />Councilmember Oliver Davis, Chairperson, Utilities Committee, reported that this <br />committee held a Public Hearing on this bill this afternoon and sends it to the full Council <br />with a favorable recommendation. <br /> <br />th <br />Mr. Gary Gilot, Director, Public Works, 13 Floor County-City Building, 227 W. <br />Jefferson Blvd., South Bend, Indiana, made the presentation for this bill. <br /> <br />Mr. Gilot advised that this bill amends Ordinance No. 9951-09 which was recently <br />passed and which authorized improvements and extensions of the City’s Sewage Works <br />through issuance and sale of revenue bonds. Additionally he advised that because of the <br />City’s duty to place a portion of the approved bond proceed funds in a separate debt <br />reserve account, the Sewage Works could not perform the project as fully contemplated. <br />To remedy this, the State Revolving Fund Loan Program (SRF) is making available <br />additional funds in the sum of $1,500,000.00. the attached ordinance amends Section II <br />of Ordinance 9951-09 to expand the project description now made possible by infusion of <br />these additional funds, specifically, improvements to Kennedy Park. No further <br />amendment of Ordinance No. 9961-09 is required because the additional SRF monies do <br />not change the total revenue bond funds of $4,600,000.00 authorized and described in <br />that bond ordinance. <br /> <br />This being the time heretofore set for the Public Hearing on the above bill, proponents <br />and opponents were given an opportunity to be heard. <br /> <br />There being no one present wishing to speak to the Council either in favor of or in <br />opposition to this bill, Councilmember Dieter made a motion for favorable <br />recommendation to full Council concerning this bill. Councilmember Oliver Davis <br />seconded the motion which carried by a voice vote of eight (8) ayes. <br /> <br />BILL NO. 82-09 PUBLIC HEARING ON A BILL OF THE <br /> COMMON COUNCIL OF THE CITY OF SOUTH <br /> BEND, INDIANA, AMENDING ORDINANCE <br /> NO. 9672-06 ENTITLED “AN ORDINANCE OF <br /> THE COMMON COUNCIL OF THE CITY OF <br /> SOUTH BEND, INDIANA, AUTHORIZING THE <br /> ACQUISITION, CONSTRUCTION AND <br /> INSTALLATION OF CERTAIN <br /> IMPROVEMENTS AND EXTENSIONS TO THE <br /> CITY’S SEWAGE WORKS, THE ISSUANCE <br /> AND SALE OF ADDITIONAL REVENUE <br /> BONDS TO PROVIDE FUNDS FOR THE <br /> PAYMENT OF THE COSTS THEREOF, THE <br /> ISSUANCE AND SALE OF BOND <br /> ANTICIPATION NOTES IN ANTICIPATION OF <br /> THE ISSUANCE AND SALE OF SUCH BONDS <br /> AND THE COLLECTION, SEGREGATION AND <br /> DISTRIBUTION OF THE REVENUES OF SUCH <br /> SEWAGE WORKS AND OTHER RELATED <br /> MATTERS” <br /> 4 <br /> <br />
