REGULAR MEETING DECEMBER22 20I6 417 <br />IJpon a motion made by Mr. Gilot, seconded by Ms. Dorau and carried, the following Resolution <br />was adopted by the Board of Public Works: <br />RESOLUTION NO. 72-2016 <br />A RESOLUTION OF THE SOUTH BEND BOARD OF PUBLIC WORKS <br />ON DISPOSAL OF UNFIT AND/OR OBSOLETE PROPERTY <br />WHEREAS, it has been determined by the Board of Public Works that the following property <br />is unfit for the purpose for which it was intended and is no longer needed by the City of South <br />Bend: <br />POLICE VEHICLE COMPUTER MOUNTS <br />WHEREAS, Indiana Code 5-22-22 permits and establishes procedure for disposal of <br />Personal property which is unfit for the purpose for which it was intended and which is no longer <br />needed by the City. <br />NOW, THEREFORE, BE IT RESOLVED by the Board of Public Works of the City of <br />South Bend that the items listed above are no longer needed by the City and/or are unfit for the <br />Purpose for which they were intended and have an estimated combined value of less than five <br />thousand dollars ($5,000.00). <br />BE IT FURTHER RESOLVED that said items may be transferred or sold at public <br />auction or private sale, without advertising. Martin, Clerk <br />ADOPT RESOLUTION NO. 73-2016 - A RESOLUTION OF THE CITY OF SOUTH BEND <br />BOARD OF PUBLIC WORKS ON TEMPORARY PARKING ON COLFAX AVENUE <br />Upon a motion made by Ms. Dorau, seconded by Mr. Mueller and carried, the following <br />Resolution was adopted by the Board of Public Works: <br />RESOLUTION NO. 73-2016 <br />RESOLUTION OF THE CITY OF SOUTH BEND BOARD OF PUBLIC WORKS <br />ON TEMPORARY PARKING ON COLFAX AVENUE <br />WHEREAS, the City of South Bend Board of Public Works ("Board") is the <br />contracting body for the City of South Bend, Indiana ("City'); and <br />WHEREAS, pursuant to Section 20-3(a)(2) of the City of South Bend Code of <br />Ordinances, the Board has the authority to specify parking restrictions to certain streets, alleys, <br />or municipal parking facilities or parts thereof; and <br />WHEREAS, pursuant to a certain ground lease between the City and the University of <br />Notre Dame ("Notre Dame') dated December 12, 2016, Notre Dame willneed access to adjacent <br />Property to establish a hydroelectricity facility in Seitz Park; and <br />WHEREAS, as result of the planned construction of the hydroelectricity facility, the City <br />needs to establish parking along Colfax Avenue (see Exhibit A attached hereto) to temporarily <br />accommodate fourteen (14) parking spots ("Parking") to offset the parking spaces temporarily <br />negated by the construction in and around Seitz Park; and <br />WHEREAS, the Parking is temporary in nature; and <br />
