PETITION <br />SPECIAL EXCEPTION PURSUANT 21- 09.3(D <br />AREA BOARD OF ZONING APPEALS <br />TWG DEVELOPMENT LLC <br />FINDINGS OF FACT <br />Filed in Clerk's Office <br />DEC n q 2016 <br />KAREEMAH FOWLER <br />CITY CLERK, SOUTH BEND, IN <br />1. THE PROPOSED USE WILL NOT BE INJURIOUS TO THE PUBLIC HEALTH, SAFETY, COMFORT, <br />COMMUNITY MORAL STANDARDS, CONVENIENCE OR GENERAL WELFARE BECAUSE: <br />This standard will be partially met by providing the dumpster screening and the perimeter landscape screening along <br />the east and west boundaries. Access to the site will be reviewed by City Engineering to comply with City standards._ <br />2. THE PROPOSED USE WILL NOT INJURE OR ADVERSELY AFFECT THE USE OF THE ADJACENT AREA <br />OR PROPERTY VALUES THEREIN BECAUSE: <br />Adjacent properties are zoned for a wide variety of uses compatible with the proposed uses. Therefore, property <br />values should not be affected in a negative manner since they will be similar value and scope. Although, as noted <br />above, the issue of where game -day parking will be accommodated may compromise the use of adjacent areas and <br />their property values. <br />3. THE PROPOSED USE WILL BE CONSISTENT WITH THE CHARACTER OF THE DISTRICT IN WHICH IT IS <br />LOCATED AND THE LAND USES AUTHORIZED THEREIN BECAUSE: <br />The project site is part of the Central Business District. A mix of medium and high density residential projects are in <br />the immediate area, along with commercial and business uses. The mixed use nature of the project is compatible with the <br />existing and future proposed uses that would allowed under the existing zoning districts. <br />4. THE PROPOSED USE IS COMPATIBLE WITH THE RECOMMENDATIONS OF THE CITY OF SOUTH <br />BEND COMPREHENSIVE PLAN BECAUSE: <br />The proposed use is consistent with Citv Plan.
