BADGER METER <br />BEACONAIK/1 AILAWAGED SOLUTION <br />InaBadger [Meter h2ASTER AGREEMENT � <br />"Total Minutes of Approved Downtime" is the cumulative time in minutes in the applicable <br />month where the Supplier applications are not available due to scheduled downtime; other <br />planned scheduled outages, or approved exclusion conditions as defiled in this Agreement. <br />In order to be included within the Total Unavailability Minutes: (a) Customer shall notify Badger <br />Meter, in writing, via email(techsupport@badgermeter.com) of the unavailability of the Portal or the <br />Service; (b) such unavailability shall be greater than fifteen (15) minutes in duration following Badger <br />Meter's receipt of such notice; and (c) Customer shall notify Badger Meter, in writing, via email <br />within twenty-four (24) hours of such unavailability that it should be included within the Total <br />Unavailability Minutes unless such unavailability is due to any Emergency Downtime, Scheduled <br />Downtime, or any unavailability of the Services due to any Force Majeure Event. <br />Service Credits <br />If Badger Meter fails to meet the BEACON Portal and Service Availability Promise, <br />Service Credits apply: <br />°/u of Availability in the <br />Month <br />Service Credit(% of <br />monthIv recurringfees) <br />>_99% <br />0% <br />>_98% and <99% <br />5% <br />>_96.5% and <98% <br />10% <br />>_95.0% and <96.5% <br />15% <br /><95.0% <br />25% <br />the following <br />©2016 Badger Meter, Inc.
