t <br />6/23/69 _ <br />COMPLAINT AGAINST PHILLIPS 66 STATION, 1902 S. MICHI_GAN STREET <br />Leonard Gunder, 113 E. Calvert Street, and William Carmichael, 114 E. Calvert <br />Street, South Bend, Indiana, appeared before.the Board to register the - <br />written complaint signed by 11 residents on East Calvert Street concerning <br />the use of the Phillips 66 Filling Station, at the corner.of E. Calvert and <br />South Michigan Street, as a "truck terminal" . In support of his complaint, <br />Mr. Gunder submitted pictures, drawing of the location, and.a tape recording <br />of the truck noises, which he stated occurred day,and night seven,days a week. <br />Upon motion made seconded and unanimously carried,.the matter was referred <br />to the Building Department for investigation, and to the Legal Department <br />for determination as to the legality of the operation of the Phillips 66 <br />Station. <br />COMPLAINT - REPAIR OF BRICK STREET WITH ASPHALT <br />Attorney Richard Doyle, 720 Park Avenue, South Bend, Indiana, appeared be- <br />fore the Board and presented a request signed by 7$ residents of the 600 to <br />800 block of Park Avenue that repairs to Park Avenue in this neighborhood, <br />being a brick street, be not repaired or resurfaced with asphalt. <br />The City Engineer stated repairs in this area were made by the Street De- <br />partment with asphalt resulting from complaints that water was standing <br />in the street; that the Street Department has since been directed not to <br />repair the brick street in this area with asphalt. <br />BUILDING DEPARTMENT - SUB -STANDARDS DIVISION <br />J. W. Adamson, Sub -Standards Director, appeared before the Board and the <br />following matters were taken up: <br />233 E. Paris Street. Chester Allen, Sr., attorney for Isiah Cathey, and <br />F. Jay Nimtz, attorney.for Grant Lewis, appeared before the Board and re- <br />ported that the controversy over the ownership of this property was expected <br />to be resolved within -t-he next 10 days. Upon motion made, seconded and <br />unanimously carried, the matter was continued for 30 days. <br />621 S. Albert Street. Mrs. Donna Skiver, Elkhart, Indiana, one of the <br />owners of this property, appeared before the Board. She related this <br />property was purchased 20 years ago in joint ownership with her husband; <br />that they have since been divorced but the title to the property remains. <br />in both their names; that they are attempting to sell the property and <br />resolve the ownership. Upon motion made, seconded and unanimously carried, <br />the matter was continued for two weeks, and Mrs. Skiver was requested to <br />secure the accessory building. <br />1640 Portage Avenue. Mr. Adamson stated the owner of this property has <br />been given a list of necessary repairs to bring it up to standard.. 'The <br />owner appeared before the Board, and objected to some of the requirements <br />particularly the electrical requirements, and agreeing that the boiler <br />house should be removed. Upon motion made, seconded and unanimously <br />carried, the matter was continued for two weeks for the owner to decide <br />what he intends to do. <br />416-420 Manitou Place. Edward J. Bartosik, the owner of this.property, <br />appeared before the Board. He stated there are three dwellings; that the <br />little house in front is occupied; he is working on the property and intends <br />to live there himself, and intends to -fix up all three units. Upon motion <br />made, seconded and unanimously carried, the matter was continued 60 days <br />to permit the owner to bring the dwellings up to standard, and the Sub - <br />Standard Director was directed to keep the property under surveillance. <br />703 W. Colfax. Lincoln Weaver, contract buyer, who purchased the property <br />six years ago, appeared before the Board. Upon motion made, seconded -and <br />unanimously carried, the matter was continued 30 days to permit the owner <br />to take care of the necessary repairs, provided, however, that the electrical <br />problem, which has been "tagged red" be taken care of immediately. <br />
