10/19/70 <br />found to be proper. No written remonstrances having been received and no <br />remonstrators having appeared , upon motion made, seconded and unanimously <br />carried, said assessment roll adopted September 14, 1970, was in all <br />things approved as presented. <br />HEARING ON ASSESSMENT ROLL - VACATION RESOLUTION NO. 3327 - ASSOCIATES <br />DISCOUNT CORPORATION <br />This being the date set, hearing was held on the assessment roll in Vacation <br />Resolution No. 3327, being for the vacation of; <br />29 feet of a public court as platted in E. Louis Kuhn's <br />Subdivision of the west Half of Large Lot No. 20 in <br />Samuel L. Cottrell's First Addition to the town of Lowell, <br />now a part of the city of South Bend. <br />The Clerk tendered proofs of publication of notice in the South Bend Tribune <br />and the Tri County News on September 25, October 2 and October 9, 1970, which <br />were found to be proper. No remonstrators having appeared and no written <br />remonstrances having been received, upon motion made, seconded and unanimously <br />.-i carried, the assessment roll is hereby approved as presented and the Vacation <br />'30 Resolution in all things ratified and confirmed and the property vacated. <br />CONFIRMATION - VACATION RESOLUTION NO. 3328 - DR. ARMAND J. RIBAUX <br />Q Hearing was resumed on Vacation Resolution No. 3328 for the vacation of: <br />a portion of the north -south alley between Penn Central <br />right of way and Otsego Avenue from the south right of <br />way line of Angela Boulevard running south 126 feet.. <br />having been continued from October 5, 1970, for contact with the petitioner, <br />Dr. Armand Rigaux. <br />An understanding having been reached with Dr. Rigaux and no remonstrances <br />having been filed against the vacation, upon motion made, seconded and <br />unanimously carried, Vacation Resolution No. 3328 adopted August 31, 1970, <br />was confirmed, subject to construction of a curb across the alley access <br />onto Angela Boulevard and the installation of a barrier to prevent through <br />traffic, by the petitioner Dr. Rigaux. And the City Engineer was directed <br />to prepare an assessment roll. <br />FINAL CONFIRMATION - VACATION RESOLUTION NO. 3329 - MIDWEST TURNKEY BUILDERS <br />After due consideration of the matter and an inspection of the site of the <br />proposed vacation by the Board, upon motion made, seconded and unanimously <br />carried, Vacation Resolution No. 3329, for the vacation of: <br />Frances Street from the north line of Miner Street extend- <br />ing north 105 feet to the south right of way line of a <br />12 foot alley as shown on the recorded plat of Lederer <br />and Longley's Subdivision of Out Lot numbered 1 in Samuel <br />L. Cottrell's First Addition to the town of Lowell, now <br />a part of the city of South Bend. This portion of the <br />street was formerly Lots 35 and 36 of said Addition. <br />was finally confirmed as adopted September 8, 1970, and said street vacated <br />conditioned upon the construction in accordance with Site Plan "B" prepared <br />by Midwest Turnkey Builders of an 18 foot wide paved alleywayQcentered on <br />the extension of Frances Street and running from the north line of Miner Street <br />north to the south line of the first east -west alley. <br />And the City Engineer is directed to prepare an assessment roll covering the <br />assessment of benefits and the award of damages to the surrounding property. <br />NET BENEFITS RECEIVED - VACATION RESOLUTION NO. 3317 - MILL RACE_ iNr- <br />In the matter of the vacation of: <br />an easement described as: that part of the west leg of the <br />east Race which is located northerly of a line parallel to <br />and 30 feet southerly of the southerly line of Hydraulic <br />
