10/19/70 found to be proper. No written remonstrances having been received and no remonstrators having appeared , upon motion made, seconded and unanimously carried, said assessment roll adopted September 14, 1970, was in all things approved as presented. HEARING ON ASSESSMENT ROLL - VACATION RESOLUTION NO. 3327 - ASSOCIATES DISCOUNT CORPORATION This being the date set, hearing was held on the assessment roll in Vacation Resolution No. 3327, being for the vacation of; 29 feet of a public court as platted in E. Louis Kuhn's Subdivision of the west Half of Large Lot No. 20 in Samuel L. Cottrell's First Addition to the town of Lowell, now a part of the city of South Bend. The Clerk tendered proofs of publication of notice in the South Bend Tribune and the Tri County News on September 25, October 2 and October 9, 1970, which were found to be proper. No remonstrators having appeared and no written remonstrances having been received, upon motion made, seconded and unanimously .-i carried, the assessment roll is hereby approved as presented and the Vacation '30 Resolution in all things ratified and confirmed and the property vacated. CONFIRMATION - VACATION RESOLUTION NO. 3328 - DR. ARMAND J. RIBAUX Q Hearing was resumed on Vacation Resolution No. 3328 for the vacation of: a portion of the north -south alley between Penn Central right of way and Otsego Avenue from the south right of way line of Angela Boulevard running south 126 feet.. having been continued from October 5, 1970, for contact with the petitioner, Dr. Armand Rigaux. An understanding having been reached with Dr. Rigaux and no remonstrances having been filed against the vacation, upon motion made, seconded and unanimously carried, Vacation Resolution No. 3328 adopted August 31, 1970, was confirmed, subject to construction of a curb across the alley access onto Angela Boulevard and the installation of a barrier to prevent through traffic, by the petitioner Dr. Rigaux. And the City Engineer was directed to prepare an assessment roll. FINAL CONFIRMATION - VACATION RESOLUTION NO. 3329 - MIDWEST TURNKEY BUILDERS After due consideration of the matter and an inspection of the site of the proposed vacation by the Board, upon motion made, seconded and unanimously carried, Vacation Resolution No. 3329, for the vacation of: Frances Street from the north line of Miner Street extend- ing north 105 feet to the south right of way line of a 12 foot alley as shown on the recorded plat of Lederer and Longley's Subdivision of Out Lot numbered 1 in Samuel L. Cottrell's First Addition to the town of Lowell, now a part of the city of South Bend. This portion of the street was formerly Lots 35 and 36 of said Addition. was finally confirmed as adopted September 8, 1970, and said street vacated conditioned upon the construction in accordance with Site Plan "B" prepared by Midwest Turnkey Builders of an 18 foot wide paved alleywayQcentered on the extension of Frances Street and running from the north line of Miner Street north to the south line of the first east -west alley. And the City Engineer is directed to prepare an assessment roll covering the assessment of benefits and the award of damages to the surrounding property.
