Mr. <br />Sweeney, Legal Department advised this procedure. <br />ADOPTION OF VACATION RESOLUTION NO. 3363,1972 - PRARIE AVENUE--WILLIAM PENN <br />Area Plan Commission having filed with the Board its unfavorable recomm- <br />endation for the vacation of the first north-wouth alley'East of Prairie <br />Avenue, running from Indiana Avenue south to the first east -west alley, <br />a discussion was had. Frank Horvath appeared before the'Board with <br />pictures showing the alley and its relation to the William Penn Organ- <br />ization, the Petitioners. Frank Wukovits, Secretary, also appeared <br />before the Board and spoke in favor of the vacation. Upon motion made, <br />seconded and unanimously carried, the following Resolution is now' <br />adopted: <br />VACATION RESOLUTION NO. 3363,1972 <br />RESOLVED BY THE BOARD OF PUBLIC WORKS AND SAFETY OF THE'CITY OF <br />SOUTH BEND, INDIANA, That it is desirable to vacate the following: <br />The first north-wouth alley east of Prairie Avenue, running <br />from Indiana Avenue south to the first east -west cross alley. <br />Reserving the rights and easements of all Utilities, and the <br />Municipal City of South Bend, ;Indiana, to construct and maintain any <br />facilities, including-, but not limited to, the following: electric, <br />telephone, gas, water, sewer, surface water control structures and ditches, <br />withing the vacatedright of way, unless such rights are released.by the <br />individual Utilities. <br />The following property may be injuriously or beneficially <br />affected by such vacation: <br />Lot 21, 22, 23 and 32 of Byerley's Addition <br />Notice of this Resolution shall be published on the 14th day of July <br />and on the 21st day of July, 1972, in the South Bend Tribune and the <br />Tri County News. <br />This Board, at its office on the 24th day of July, 1972, at <br />9:30 A.M. will hear and receive remonstrances from all persons interested <br />in or affected by these proceedings. <br />Adopted this 10th day of July, 1972. <br />BOARD OF PUBLIC WORKS AND SAFETY <br />s/ Charles A.
