REGULAR MEETING <br />MARCH 5, 1973 <br />A regular meeting of the Board of Public Works convened at 9:30 a.m, on Monday, <br />March 5, 1973 with all members present. Minutes of the last meeting were <br />reviewed and approved. <br />Mr. Scott Sandrock and Mr. James Mclntee, students of Professor Bartholomew's <br />Government Class at the University of Notre Dame, were welcomed to the meeting <br />as observers. <br />HEARING ON VACATION RESOLUTION NO. 3374-73 and 3375-73 <br />This being the date set, hearing was held on Vacation Resolution No. 3374-73 and <br />Vacation Resolution 3375-73 simultaneously for the vacation of the alleys known <br />as Hibbard Court, being the alley between Washington and Jefferson Boulevard, <br />running west from Michigan Street to the East line of the North -South alley <br />between Michigan and Main Streets and the alley between Washington and Jefferson <br />Boulevard, running East from Michigan Street to the west line of the North -South <br />alley between Michigan and St. Joseph Streets. <br />The Clerk tendered proofs of publication of notice in the South Bend Tribune <br />and the Tri-County News on February 16 and February 23, 1973. <br />Attorney Louis Cha leau was resent representing the <br />O Y P P p g petitioner, Mr. Karl King, <br />who was also in attendance. <br />C�. <br />Because letters from all the utilities have been received waiving easement rights, <br />the Board, upon motion made, seconded and carried, deleted the paragraph referring <br />to easement rights in both resolutions. <br />No remonstrators having appeared and no written remonstrances having been filed, <br />upon motion made, seconded and carried, the Board ratified and confirmed Vacation <br />Resolution No. 3374-73 and said alley is vacated. Upon motion made, seconded and <br />carried, the Board ratified and confirmed Vacation Resolution No. 3375-73 and <br />said alley is vacated. <br />The City Engineer is directed to prepare an assessment roll showing the award of <br />damages and the assessment of benefits to the surrounding properties. <br />PETITION TO VACATE ALLEY - FIRST EAST AND WEST ALLEY SOUTH OF PRAIRIE AVENUE <br />Otto Keres, Mary Jane Keres and Mary Lewandowski file their petition for the <br />vacation of the first east and west alley south of Prairie Avenue running from <br />Gertrude Street West to the first north and south alley in Romig's 1st Addition. <br />Upon motion made, seconded and carried, the petition was referred to the Engineering <br />Department for study and recommendation to the Board. <br />AGREEMENT FOR SEWER CONSTRUCTION - MR. & MRS. DON HUFFAKER <br />An agreement for sewer construction between the Board of Public Works and Mr. <br />& Mrs. Don Huffaker, 1325 East Roelke Drive, was upon motion made, seconded and <br />carried, approved and signed by the Board. <br />REQUEST FROM GRAND TRUNK RAILROAD TO ABANDON_ CERTAIN UNDERGROUND CONDUITS <br />Mr. Richardson explained that the City had previously granted the Grand Trunk <br />Western Railroad Company the right to abandon certain conduits and manholes on <br />Western Avenue. The railroad has now sent an amendment to their agreement with <br />the City indicating what it wants to abandon and what it wants to continue <br />to use. Upon motion made, seconded and carried, the Board approved the amended <br />agreement. <br />QUIT -CLAIM DEED - NORTHEAST CORNER BENDIX DRIVE AND LATHROP STREET <br />The Board received a Quit -Claim Deed from Hartman Builders, Inc. for property <br />at the Northeast corner of Bendix Drive and Lathrop Street deeding.an additional <br />20 feet of right-of-way to the City for the proposed improvement of Bendix Drive <br />and Lathrop and the Industria] Park construction. Upon motion made, seconded <br />and carried, the deed was accepted by the City and referred to the City Attorney's <br />Office for recording. <br />
