1332 <br />REGULAR MEETING <br />APRIL 14, 1975 <br />A regular meeting of the Board of Public Works was convened at <br />9:30 a.m, on Monday, April 14, 1975 by James V. Barcome with Mr. <br />Barcome and Mr. Seitz present. Deputy City Attorney Kathleen <br />Cekanski was also, present. Minutes of the previous meeting were <br />reviewed and approved. <br />PUBLIC HEARING ON ASSESSMENT ROLL _ VACATION RESOLUTION NO. 3409 <br />This being the date set, hearing was held on the Assessment Poll <br />for Vacation Resolution No. 3409, 1975, for the vacation of portions <br />of Donald and Fox Streets, from Columbia east to Fellows and the <br />first east -west alley south of Bowman between Fellows and Rush and <br />the north -south alley between Fellows and Rush Streets from Bowman <br />to the aforesaid east -west alley, and a portion of Rush south from <br />Bowman to the first east -west alley, City of South Bend. The Clerk <br />tendered proofs of publication of notice in the South Bend Tribune <br />and the Tri-County News, which were found to be sufficient. <br />No remonstrators appeared and no written remonstrances having been <br />filed, upon motion made, seconded and carried, the Assessment Roll <br />showing no net damages and no net benefits was approved as adopted <br />and said resolution is in all things ratified and,confirmed and <br />said proceedings closed. <br />PUBLIC HEARING ON ASSESSMENT ROLL - VACATION RESOLUTION NO. 3410 <br />This being the date set, hearing was held on the Assessment Roll <br />for Vacation Resolution No. 3410, 1975, for the vacation of the <br />east -west alley between Marion Street and Madison Street, running <br />east from the first north -south alley east of Michigan Street to <br />the vacated St. Joseph Street, -City of South Bend. The Clerk <br />tendered proofs of publication of notice in the South Bend Tribune <br />and the Tri-County News which were found to be sufficient. Mr. John <br />Obenchain, Attorney for the petitioners, the Milton Home, was <br />present. Mr. Obenchain said, as a point of clarification, that this <br />entire alley was taken from Lot 132 and the property when vacated <br />should revert to that lot. The Board took note of this information <br />for the record. Upon motion made, seconded and carried, the Board <br />approved the Assessment Roll showing no net damages and no net <br />benefits as adopted, and said resolution is in all things ratified <br />and confirmed and said proceedings closed. <br />ADOPTION OF RESOLUTION NO. 10 <br />Upon motion made, seconded and carried, the following resolution <br />was adopted: <br />RESOLUTION NO. 10, 1975 <br />WHEREAS, the Board of Public Works has found it necessary in the <br />best interests of the public safety and welfare to construct <br />street improvements on Jefferson Street between Hill Street <br />and Logan Street, and <br />WHEREAS, the improvements to the aforesaid street are compatible <br />with the Urban Area Transportation Study, and <br />WHEREAS, the costs for these improvements are to be pro -rated <br />between Federal Aid Urban Funds and the Cumulative Capital <br />Improvement Funds, and <br />WHEREAS, the Board of Public Works has the authority to make such <br />improvements as provided by the Acts of the General <br />Assembly (I.C. 18-1-16-15 and others). <br />
