I Z' REGULAR MEETING NOVEMBER 1974 A regular meeting of the Board of Public Works was convened at 9:30 a.m, on Monday, November 25, 1974 with all members present. Deputy City Attorney Kathleen Cekanski was also present. Minutes of the previous meeting were reviewed and approved. ACKNOWLEDGEMENT RECEIVED - FAMILY OF J. EMMETT MILLER The Board received an acknowledgement of thanks from the family of J. Emmett Miller, Mayor Miller's father, for the expression of sympathy received. PUBLIC HEARING - VACATION RESOLUTION NO. 3406, 1974 This being the date set, hearing was held on Vacation Resolution No. 3406, 1974 for the vacation of Sunnymede Avenue from the west right-of-way line of 35th Street to the west line of Lots 7 and 18 of Jerome First Addition to the City of South Bend as amended. The Clerk tendered proofs of publication of notice in the South Bend Tribune and the Tri-County News which were found to be sufficient. Mr. James Groves, Attorney for the petitioner, the Whitmore Corpor- ation, was present and said he would answer any questions. He said the vacation is being,requgsted.as part of a rezoning proposal which will be presented to the Area Plan Commission in the near future. No remonstrators having appeared and no written reponstrances having been filed, upon motion made, seconded and carried, the Board ratified and confirmed Vacation Resolution No. 3406 and said portion of Sunnymede Avenue is vacated. The City'Engineer is directed to prepare an assessment roll showing the award of damages and the assessment of benefits to the surrounding properties. RECEIPT OF LETTER - ZUCKERBERG UNIFORM COMPANY The Board received a letter from the Zuckerburg Uniform Company. It was received on Wednesday, November 20 and was not marked "Sealed Bid". The letter was opened and it indicated that the company was not submitting a bid on Bureau of Fire Uniforms for next year. RECOMMENDATION RE: PETITION TO VACATE A PORTION OF COLFAX AVENUE AND A NORTH -SOUTH ALLEY The Board received a recommendation from the Area Plan Commission in regard to the petition of the O'Brien Corporation to vacate Colfax Avenue from Jackson Street west to the first north -south alley and the north -south alley from Orange Street to Washington between Brookfield and Jackson. The Area Plan Commission held a hearing on the petition and recommended the vacation favorably to the Board. Upon motion made, seconded and carried the recommendation was ordered filed and the petition was referred to the Division of Engineering for preparation of the Vacation Resolution. RECOMMENDATION RE: PETITION TO VACATE THE ALLEY BETWEEN ST. LOUIS AND ST. PETER STREET. The Board received a recommendation from the Area Plan Commission in regard to the petition of St. Joseph Hospital to vacate the north - south alley east of St. Louis, running south from Madison to the first cross alley. The ARea Plan Commission held a hearing on the petition and recommended the vacation favorably to the Board. Upon motion made, seconded and carried, the recommendation was ordered filed and the petition was referred to the Division of Engineering for preparation of the Vacation Resolution.
