REGULAR MEETING OCTOBER 4., 1976 <br />COMPLAINT - HOUSE MOVED TO 4625. FELLOWS <br />Mrs. Fred Wilson, 4701 S. Fellows Street,'was present to speak to <br />the Board about a house moved on the property at 4625 S. Fellows. <br />Mrs. Wilson said the Board of Public Works approved the house move <br />in August of 1975. The owner, Jaries Locker, got the permits to move <br />the house and it was moved onto the lot in March of 1976, but is <br />still up on temporary supports and is a hazard. Mrs. Wilson said <br />people get into the house and vandalism has occurred in the neighbor- <br />hood. Property values of other houses in the area have depreciated <br />because of this house. Some houses^have been put up for sale and <br />realtors have indicated that this house, in its present condition, is <br />a deterrent to sales of other homes. Mrs. Wilson said the residents <br />of the area are attempting to improve and maintain their own <br />properties and this house is an eyesore and a hazard. Weeds have <br />grown up on the lot making it unsightly. She asked that the Board <br />take some action in the matter. Mrs. Lewis Mason, 4616 S. Fellows <br />Street, said when this lot was vacant they were advised that it would <br />never be sold for a building lot because it was a drain field and any <br />building would interfere with the natural drainage`. She said they <br />had assumed no house would ever be put on the lot because of the drainage <br />problem. Mr. Farrand said the Board='s.ent Mr. Locker a letter on July <br />28, 1976 expressing their concern about the temporary location of the <br />house and asking that he notify them immediately of his intentions, <br />Mr. Farrand said Mr. Locker did not respond to the Board's letter. <br />The matter was taken under advisement by the City Attorney's Office. <br />Deputy City Attorney Georgia Luks recommended that the Board refer <br />the matter to the Board of Public Safety and ask them to schedule a <br />hearing requiring the owner to show cause why the structure should <br />not be demolished. Mr. Mullen made a motion that the structure at <br />4625 S. Fellows Street be referred to the Board of Public Safety with <br />the request that they schedule a show cause hearing as soon as <br />possible. Residents present were advised that they could attend the <br />Board of Public Safety meeting on Tuesday, October 5 at which time <br />this matter will be before that Board and a hearing date set. <br />FILING OF PETITION TO VACATE A PORTION OF SPRUCE STREET <br />Slutsky-Peltz Plumbing & Heating Company, Inc. et al files a petition <br />to vacate a portion of Spruce Street from Washington Street south <br />to the first east -west alley. The vacation is being requested to <br />allow for expansion of the Company's present operation. Upon notion <br />made by Mr. Farrand, seconded by Mr. Brunner and carried, the petition <br />was filed and referred to the Bureau of Engineering for preliminary <br />review and recommendation. <br />FILING OF ASSESSMENT ROLL - VACATION RESOLUTION NO. 3431 <br />Rollin E. Farrand, P. E., City Engineer, files with the Board an <br />Assessment Roll for Vacation Resolution No. 3431 for the vacation of <br />the, north -south alley between Portage Avenue and Anderson Street from <br />the south right-of-way line of Kinyon Street thence southerly <br />to the north right-of-way line of Bulla Street in the Morris Park <br />Addition to the City of South Bend, Indiana. The following property <br />may be injuriously or beneficially affected by such vacation: <br />Lots 7 through 20 in the Morris Park Addition to the City of South <br />Bend, Indiana. <br />The Board finds that each of said lots have been benefited in.the <br />amount of $0.00 and damaged in the amount of $0.00. -_ <br />Upon motion made by PZr. Farrand, seconded by Mr. Brunner and carried, <br />the Board filed the Assessment Roll and set Monday, November 8, 1976 <br />at 9:30 a.m, as the time and the Board of Public Works hearing room <br />as the place where all persons interested in or affected by such <br />vacation may be heard. <br />1 <br />
