REGULAR MEETING <br />AUGUST 30, 1976 <br />A regular meeting of the Board of Public Works was convened at <br />9:30 a.m, on Monday, August 30, 1976 by President Rollin E. Farrand <br />with Mr. Farrand, Mr. Brunner and Mr. Mullen present. Deputy City <br />Attorney Georgia Luks was also present. <br />MINUTES OF AUGUST 23 MEETING APPROVED <br />Mr. Mullen reported that the minutes of the August 23 meeting of <br />the Board had been reviewed and he made a motion that the minutes be <br />accepted as submitted. Mr. Brunner seconded the motion and it <br />carried. <br />PUBLIC HEARING - VACATION RESOLUTION NO. 3430 <br />This was -the date set for holding a public hearing on Vacatio <br />Resolution No. 3430, 1976 for the vacation of the 18' east -west <br />alley between Kenmore Street and Falcon,Street, North of Washington <br />Street, being the center 1V of former Colfax Avenue which was <br />vacated under Resolution No. 2610, excepting from the vacation the <br />alley intersection:. The Clerk tendered proofs of publication of <br />notice in the South Bend Tribune and the Tri-County News which were <br />found to be sufficient. Petitioners are William Tuberville and <br />the Department of Redevelopment. Mr. Tuberville was present and advised <br />the Board that he was seeking the vacation in order to build a garage <br />and would use the rest of the property for a garden. Mr. Farrand <br />noted that the Area Plan Commission held a public hearing on the <br />petition and recommended it favorably to the Board of Public Works. <br />No remonstrators appeared and no -written remonstrances were received. <br />Upon motion..made by Mr.. Mullen, seconded by Mr. Farrand, and carried, <br />the Board confirmed Vacation Resolution No. 3430 and said alley is <br />vacated, and the resolution is referred to the Department of <br />Engineering for preparation of an Assessment Roll. <br />BID AWARD TABLED - FIRE DEPARTMENT PUMPER <br />Chief Robert L. Snider submitted to the Board a recommendation on <br />the bids received by the Board for a 1250 GPM pumper.f_or the Fire <br />Department. Mr. Farrand asked Chief Snider whether a detailed <br />tabulation of all bids received -had been prepared and Chief Snider <br />said they had not had time to prepare such a tabulation. Mr. Farrand <br />made a motion that the Board take the matter under advisement until <br />September 7 and that the Fire Department prepare a bid tabulation <br />for that date. Mr. Brunner seconded the motion and it carried. <br />ADOPTION OF VACATION RESOLUTION NO. 3431, 1976 <br />Upon motion made by Mr. Farrand, seconded by Mr. Mullen.and carried, <br />the following resolution was adopted by the Board: <br />VACATION RESOLUTION NO. 3431, 1976 <br />RESOLVED BY THE BOARD OF PUBLIC WORKS OF THE CITY OF SOUTH BEND, <br />INDIANA, That it is desirable to vacate the following: <br />The north -south alley between Portage Avenue and <br />Anderson Street from the south right-of-way line of <br />Kinyon Street thence southerly to the north right-of-way <br />line of Bulla Street in the Morris Park Addition to the <br />City of South Bend, Indiana. <br />Reserving the rights and easements of all Utilities and the Municipal <br />City of South Bend, Indiana, to construct and maintain any facilities, <br />including, but not limited to, the following: electric, telephone, <br />gas, water, sewer, surface water control structures and ditches, within <br />the vacated right of way, unless such rights are released by the <br />individual Utilities. <br />The following property may be injuriously or beneficially affected <br />by such vacation: <br />Lots 7 through 20 in the Morris Park Addition to the City of South <br />Bend, Indiana. <br />1 <br />11 <br />
