REGULAR MEETING AUGUST 30, 1976 A regular meeting of the Board of Public Works was convened at 9:30 a.m, on Monday, August 30, 1976 by President Rollin E. Farrand with Mr. Farrand, Mr. Brunner and Mr. Mullen present. Deputy City Attorney Georgia Luks was also present. MINUTES OF AUGUST 23 MEETING APPROVED Mr. Mullen reported that the minutes of the August 23 meeting of the Board had been reviewed and he made a motion that the minutes be accepted as submitted. Mr. Brunner seconded the motion and it carried. PUBLIC HEARING - VACATION RESOLUTION NO. 3430 This was -the date set for holding a public hearing on Vacatio Resolution No. 3430, 1976 for the vacation of the 18' east -west alley between Kenmore Street and Falcon,Street, North of Washington Street, being the center 1V of former Colfax Avenue which was vacated under Resolution No. 2610, excepting from the vacation the alley intersection:. The Clerk tendered proofs of publication of notice in the South Bend Tribune and the Tri-County News which were found to be sufficient. Petitioners are William Tuberville and the Department of Redevelopment. Mr. Tuberville was present and advised the Board that he was seeking the vacation in order to build a garage and would use the rest of the property for a garden. Mr. Farrand noted that the Area Plan Commission held a public hearing on the petition and recommended it favorably to the Board of Public Works. No remonstrators appeared and no -written remonstrances were received. Upon motion..made by Mr.. Mullen, seconded by Mr. Farrand, and carried, the Board confirmed Vacation Resolution No. 3430 and said alley is vacated, and the resolution is referred to the Department of Engineering for preparation of an Assessment Roll. BID AWARD TABLED - FIRE DEPARTMENT PUMPER Chief Robert L. Snider submitted to the Board a recommendation on the bids received by the Board for a 1250 GPM pumper.f_or the Fire Department. Mr. Farrand asked Chief Snider whether a detailed tabulation of all bids received -had been prepared and Chief Snider said they had not had time to prepare such a tabulation. Mr. Farrand made a motion that the Board take the matter under advisement until September 7 and that the Fire Department prepare a bid tabulation for that date. Mr. Brunner seconded the motion and it carried. ADOPTION OF VACATION RESOLUTION NO. 3431, 1976 Upon motion made by Mr. Farrand, seconded by Mr. Mullen.and carried, the following resolution was adopted by the Board: VACATION RESOLUTION NO. 3431, 1976 RESOLVED BY THE BOARD OF PUBLIC WORKS OF THE CITY OF SOUTH BEND, INDIANA, That it is desirable to vacate the following: The north -south alley between Portage Avenue and Anderson Street from the south right-of-way line of Kinyon Street thence southerly to the north right-of-way line of Bulla Street in the Morris Park Addition to the City of South Bend, Indiana. Reserving the rights and easements of all Utilities and the Municipal City of South Bend, Indiana, to construct and maintain any facilities, including, but not limited to, the following: electric, telephone, gas, water, sewer, surface water control structures and ditches, within the vacated right of way, unless such rights are released by the individual Utilities. The following property may be injuriously or beneficially affected by such vacation: Lots 7 through 20 in the Morris Park Addition to the City of South Bend, Indiana. 1 11
