Z a9 <br />REGULAR MEETING <br />AUGUST 2, 1976 <br />1 <br />1 <br />1 <br />A regular meeting of the Board of Public Works was convened -at <br />9:30 a.m. on Monday, August 2, 1976 by President Rollin E. <br />Farrand, with Mr. Farrand and Mr. Brunner present. Deputy <br />City Attorney Georgia Luks was also present. . <br />MINUTES OF PREVIOUS MEETING APPROVED <br />Mr. Brunner reported that the minutes of the July 25 meeting had <br />been reviewed and he made a motion that they be approved as submitted. <br />The motion was seconded by Mr. Farrand and carried. <br />PUBLIC HEARING, VACATION RESOLUTION 140.` 3428, 1976- VALUE HOUSE <br />This being the date set, hearing was held on Vacation Resolution <br />No. 3428 for the vacation of the north -south alley running north <br />from Marion Street to the intersection of said alley with the east - <br />west alley running west from St. Joseph Street. <br />The Clerk tendered proofs of publication of notice in the South <br />Bend Tribune and the Tri-County News which were found to be sufficient. <br />Mr. Max Koenig, representing the petitioner, Value House, was present, y <br />Mr. Koenig said the petitioners own the property abutting this alley <br />and would like to build across the alley to expand their facilities. <br />Mr. Farrand asked Mr. Koenig to explain the dedication which was made <br />by the petitioners in conjunction with this petition to vacate the <br />alley. Mr. Koenig said, in order to provide a 45 foot turning <br />radius for trucks and vehicles using the alley from St. Joseph <br />Street, they have dedicated the necessary right-of-way to provide <br />for turns. Mr. Koenig said Value House will have loading docks and <br />want to provide trucks access into the alleys. Mrs. Howard Hardy <br />was present and inquired whether this vacation would affect the <br />owners of Lots 4 and 5. She was advised that the alley adjacent to <br />Lot 5.from Navarre Street to the intersecting alley as well as the <br />alley from the intersecting alley to St. Joseph Street will remain <br />open. Mrs.. Hardy said she would want to advise prospective purchasers <br />of the property whether the alley would be open. Mrs. Hardy asked <br />whether those property owners could also petition the Board to close <br />the alleys and Mr. Farrand said that would be possible and the <br />petition would be handled by the Board in the usual manner for such <br />vacation petitions. Mr. William Brooks, 516 N. St. Joseph Street, <br />inquired about the horseshoe shaped alley now open from Navarre Street <br />west to the intersecting alley and then south and east to Navarre. <br />The Board explained to Mr. Brooks that this horseshoe alley is not <br />affected by this vacation and will remain open. David A. Wells, <br />Manager of the Bureau of Design and Administration, informed the Board <br />that he had discussed this proposed vacation with firefighters from <br />Station #2 on Marion Street and they indicate they have never used <br />the alley to be vacated for fire fighting equipment. Mrs. Hardy <br />and Mr. Brooks indicated that their questions had been answered. <br />Mr. Farrand made a motion that Vacation Resolution No. 3428 be <br />confirmed and referred to the Department of Engineering for preparation <br />of the Assessment Poll. The motion was seconded by Mr. Brunner and <br />carried. <br />ADOPTION OF VACATION RESOLUTION NO. 3430, 1976 <br />The following resolution was, upon motion made by Mr. Farrand, <br />seconded by Mr. Brunner and carried, adopted. <br />VACATION RESOLUTION NO. 3430 <br />RESOLVED BY THE BOARD OF PUBLIC WORKS. OF THE CITY OF SOUTH BEND, <br />INDIANA, That it is desirable to vacate the following: <br />The 18' East-West alley between Kenmore Street and <br />Falcon Street North of Washington Street, being the <br />center 18' of former Colfax Avenue which was vacated <br />under Resolution No. 2610, excepting from the vacation <br />the alley intersection. <br />Reserving the rights and easements of all Utilities and the Municipal <br />Citv of South Bend, Indiana, to construct and maintain any facilities <br />
