REGULAR MEETING <br />JULY 6, 1976 <br />"Dear Messrs. Podell and by owski.:. <br />July 1, 1976 <br />Please be advised that the hospital has just learned from <br />Marshall Erdman & Associates that they intend pouring <br />concrete in the area where the house is presently located <br />this Tuesday, July 6, 1976, and that the house presently <br />lies over a part of the area involved. <br />This is in addition to the problems we discussed in our <br />letter of June 25, 1976. <br />Yesterday, Mr. Podell advised rile that you just now are, <br />procuring the necessary permit from the City of South <br />Bend to move the house to the property on Devon Circle, and <br />that hearing will be held this Tuesday, July 6, 1976. As <br />there is always a possibility this permit will not be given <br />it is our suggestion that you have an alternate plan available' <br />to have that house moved Tuesday morning,•or have it raised <br />at your expense. <br />If the house is not moved to the far corner of the property <br />at the street line, within the next day, and is finally <br />removed from the property next Tuesday, our client reserves <br />the right to exercise its right to have the house raised <br />at your expense. <br />Please further understand that you will be held responsible <br />for all damage and extra expense incurred to date, as a result <br />of the house remaining on the premises, even though you <br />conform to this letter. <br />Yours very truly, <br />s/ William N. Farabaugh <br />Chapleau, Roper, Mclnerny,. <br />Ifinczeski & Farabaugh " <br />Mr. Podell said he has secured a loan from a bank to fix the house. <br />Mr. Farrand asked Mr. Podell how he intends to renovate the house. <br />Mr. Podell said he would subcontract the interior work but would do <br />some of the exterior work himself, as he is a -bricklayer. Mr. Podell <br />said some of the neighbors on Devon Circle who received the letter <br />said they have no objection to the house being moved there. He said <br />he is purchasing the lot from William Voor, who is an adjacent <br />property owner. Dr. Thomas Pilot advised the Board that when he <br />received the letter he did tell Mr. Podell that he had no objection <br />to the move. However, he said he has now seen the property and said, <br />although he is inexperienced in such matters, he was shocked at the <br />appearance of the house. He said it is a shambles. He said he now <br />withdraws his statement to Mr. Podell that he had no objection to <br />the move. Dr. Pilot said in the interests of fairness to the property <br />owners, five days notice is not sufficient time to determine the <br />facts in the case. He noted that Forrest Lest was not available on <br />Friday, Saturday or Monday to discuss this matter with property owners <br />and said they should be allowed additional time before action is <br />taken. Dr. Pilot said they have Mr. Podell's assurance that he will <br />make repairs, but he said it will cost a large sum of money. He <br />asked that an extension of time be given. Mr. Farrand noted that <br />one of the things that will occur if an extension is given is that <br />the question will become moot, because there will be no house to -move. <br />Dr. Martin Feferman said there is no question that this will decrease <br />the value of other properties on Devon Circle if the house is moved <br />in. He said it will cost Mr. Podell a great deal of money to <br />repair the house. He asked what guarantees the property owners have <br />that he will live up to his commitment. He said there ought to be <br />some safeguards to protect the adjacent property owners, so that the <br />house will not become a menace and a hazard after it is moved. He said <br />
