REGULAR MEETING <br />APRIL 26, 1976 <br />Mr. Matson said he believed the concept of Barrett Law projects <br />was for urban city areas and was- not intended to be used in -the <br />suburbs and their environs. Mr. Farrand said it appeared that <br />the remonstrators had 20 plus signatures on their remonstrance <br />petition and this reduces the discretion of the Board in the matter. <br />He then made a motion that the Board take the matter under <br />advisement for one week to allow the Department of Public Works to <br />verify the signatures on the petition. The Board will make a <br />decision on the matter on May 3, 1976. Mr. Brunner seconded the <br />motion and it was carried. Mr. Beutter asked if the property owners <br />do have the required signatures will the matter be closed or can <br />the Board override the remonstrance. Mr. Farrand said there are <br />means to do that but he did not have the feeling from the members of <br />the Board that they would do so. <br />HEARING CONTINUED - VACATION RESOLUTION NO. 3388 <br />William Voor, Attorney for petitioner Poland Goheen, requested <br />that the matter of the petition to vacate the northwest -southeast <br />alley between George Avenue and Marietta Street, North of the <br />Cooper Bridge (U.S. 23) right-of-way, from the Cooper Bridge right- <br />of-way Northwest to the south right-of-way line of the first south- <br />west -northeast alley, lying between Lots 14 and 15 of Frantz 2nd <br />Addition and Lot 13 of Frantz 3rd Addition be brought back before <br />the Board. The public hearing on this petition was held on <br />November 26, 1973, continued on December 3, 1973 and on December <br />10, 1973. At that time, the matter was tabled until Mr. Voor and <br />Mr. Goheen could work out a problem with Isaiah Steed, a property <br />owner owner in the area who had -questioned whether he would still <br />have access to his property.. Mr. Voor and Mr. Goheen were present. <br />Mr. Voor advised the Board that the objections'of Mr. Steed to the <br />vacation were in regard to access to his garage. Mr. Steed was <br />present and said his property is fenced and his garage faces the <br />area to be vacated. He said he was only concerned that he not be <br />denied access to his property. Mr. Voor displayed a drawing to <br />the Board of the area in question and indicated that there is a 12 <br />foot opening. Mr. Steed said the problem is with the turning radius <br />for him. Mr. Goheen said the alley to be vacated has been virtually <br />abandoned by the City and they do not maintain it. He said he would <br />have no objection to Mr. Steed backing his car into this alley. <br />Mr. Goheen said he owns the property on both sides of the alley to be <br />vacated and is trying to preserve a house in the area. He said <br />the State of Indiana took part of the property during the construction <br />of the Cooper Bridge. Mr. Goheen said Mr. Steed might sell his <br />property at some time. Mr. Steed said he is only concerned with <br />access to his property and said Mr. Goheen could also sell his <br />property. Mr. Brunner asked Mr. Goheen if he would be willing to <br />give Mr. Steed an easement right. Mr. Goheen said he did not intend <br />to close the alley but he would be willing to give Mr. Steed a letter <br />allowing him to drive onto the property. The Board requested that <br />P1r. Goheen send them a copy of his letter to Mr. Steed and the matter <br />was tabled until a copy of the letter has been received. <br />REQUEST FOR WEST SIDE VETERAN'S MEMORIAL DAY PARADE <br />The Board received a request from the West Side Veteran's Memorial <br />Day Committee to hold their annual parade on Monday, May 31, 1976 <br />beginning at 9:00 a.m, at Olive and Ford Streets. Indemnity insurance <br />is being provided. Upon'motion made by Mr. Farrand, seconded by <br />Mr. Mullen and carried, 'the request was referred to the Bureau of <br />Traffic and Lighting and the Police Department Traffic Detail for <br />review and recommendation. <br />REQUEST TO ADVERTISE FOR BIDS FOR POLICE DEPARTMENT TRANSCEIVERS <br />The Board received a request from Chief Michael Borkowski to advertise <br />for bids for fifteen portable transceivers. Mr. Farrand said he <br />understood the request was being made in order to allow the Department <br />to increase the size of the foot patrols. Chief Borkowski's letter <br />indicated the money was to come out of the Police Department budget. <br />
