22 <br />REGULAR MEETING FEBRUARY 17. 1976 <br />vault. The actual cost of the�'vault is $85.00 and the other $75.00 <br />is quietused into the Cemetery Trust Fund. Mr. Mullen asked how <br />many funerals are conducted at City Cemetery in a year. Mr. <br />Marosz said there were 44 last year. Tor. Brunner said it is <br />possible that some funerals are scheduled on Saturday as a convenience <br />to the families. Mr. Marosz asked that the Board review the <br />matter and determine what the policy should be Mr. Farrand made <br />a motion that the letter be filed and the matter taken under <br />advisement for further: study by the Board. <br />REPORT - PETITION TO VACATE EAST -WEST ALLEY WEST OF 500 NORTH <br />LAFAYETTE <br />The Department of Public Works reported to the Board of Public <br />Works that the petition of the Houser,Medical Corporation to <br />vacate the east -west alley lying between Lots 363 and 364 as shown <br />on the original Plat of the Town, now -,C,i.t.y; of ,South Bend, extending <br />west from the west line of Lafayette Boulevard"to the east line of <br />the first north -south alley west of ;Lafayette Boulevard had been <br />reviewed. The report indicated that the Department of Public Works <br />has no objection to the vacation, subject to the existing utility <br />easements. Upon motion made, seconded and carried, the report was <br />ordered filed and further action will be delayed until the <br />recommendation of the Area Plan Commission has been received. <br />BID ADVERTISING APPROVED' BUREAU OF STREETS 140T MTx TRATTYP <br />Mr. Farrand requested permission of the Board to advertise for <br />bids for a hot mix trailer for the Bureau of Streets. He said this <br />would enable the Department to patch streets in cold weather. <br />The estimated cost is $7800. An ordinance has been filed with the <br />Common Council for the appropriation of the funds. Upon motion <br />made by Mr. Farrand, seconded by Mr. Brunner and carried, the <br />Board approved the request and the Clerk was directed to advertise <br />for bids.on February 20 and 27, with sealed bids to be reeeived <br />at 9:30 a.m. on Monday, March 8, 1976. <br />REQUEST TO LEASE PROPERTY TO LANDMARK OF INDIANA INC. <br />The following request was received: <br />"Board of,Public Works <br />Gentlemen: <br />In the spring of 1974, my company attempted to acquire <br />the Northwest corner of Michigan and Marion Streets in <br />South Bend, Indiana from the Turner Hall. It was my <br />intent at the time to construct and lease back a Rustler's <br />Steak House. <br />Upon application for the curb cuts on this endeavor I was <br />informed that a connector between Michigan Street and <br />Main Street was planned at this intersection. This <br />required a re-evaluation of the project. <br />Should I have gone ahead and insisted on the permits, the <br />City would have been faced with condemning newly improved <br />property and a business. The restaurant would also have to <br />consider the apparent eminent threat of condemnation. <br />The outcome was an agreement I entered into with the City, <br />selling them the entire tract of land with an option to re- <br />purchase for one year that portion not needed by the <br />connector, at the same cost per square foot as I sold it to <br />the City. Within this one year, the City was to determine <br />the exact amount of land they would need. This transaction <br />was consummated in July, 1975. <br />
