REGULAR MEETING OCTOBER 24, 1977 <br />does not include any rental service for equipment during the <br />contract period. Those items would be billed separately and that <br />raises the question of whether or not rental services would raise <br />the price of the contract beyond $5,000, requiring bidding. <br />Mr. Brunner suggested that the contract be reviewed by the Legal <br />Department. Upon motion made by Mr. McMahon, seconded by Mr. <br />Brunner and carried, the contract was referred to the Legal <br />Department for review and recommendation. The Board then discussed <br />the matter of whether or not such contracts should be entered into <br />by the Century Center Board of Managers instead of this Board. <br />Mr. McMahon said the contract was brought before this Board because <br />the funds are under the direct control of the City Controller. <br />Mr. Brunner said the statute is clear that the Board of Managers has <br />the right to contract but the matter needs some clarification and <br />he recommended that the matter be reviewed by the Legal Department <br />and a recommendation made. <br />WORK STUDY AGREEMENT WITH IUSB APPROVED <br />Peter H. Mullen, City.Controller, submitted to the Board a Work - <br />Study Agreement with Indiana University at South Bend. The agreement <br />provides for the City to pay twenty per cent, or approximately $14.00 <br />a week, for the wages of one employee who will be working at Century <br />Center as Assistant Volunteer Coordinator. Upon motion made by Mr. <br />McMahon, seconded by Mr. Mullen and carried, the agreement was <br />approved and will be submitted to Indiana University for signature. <br />CONDITIONAL AWARD MADE - CENTURY CENTER PARKING LOT IMPROVEMENTS <br />John E. Leszczynski, Manager of the Bureau of Public Construction, <br />submitted to the Board a tabulation of bids received for the Century <br />Center Parking Lot and Improvements. He noted that an error was <br />made in the extension of unit prices on the bid of Rieth-Riley <br />Construction Company and correction of this error makes them the <br />low bidder at $194,871.54. Deputy City Attorney Terry A. Crone <br />submitted his written opinion that unit prices govern in a bid <br />situation. Upon motion made by Mr. McMahon, seconded by Mr. <br />Brunner and carried, the opinion was filed. Mr. McMahon reported <br />that the E.D.A. office in Chicago has reviewed the bid documents <br />and has approved the award, subject to approval of the funding. <br />Upon motion made by Mr. McMahon, seconded by Mr. Brunner and carried, <br />the Board accepted the bid and approved the contract with Rieth-Riley <br />Construction Company for the Century Center Parking Lot Improvements <br />at a total cost of $194,871.54, subject to approval of the funding <br />by the Common Council. The Clerk was directed to notify Mr. <br />Leszczynski to issue a Notice to Proceed to the contractor on Tuesday, <br />October 25, 1977 if funding is approved by the Common Council. <br />APPROVAL OF CONTRACT - WESTERN AVENUE VIADUCT LIGHTING <br />The Board had awarded the bid for the Western Avenue Viaduct <br />Lighting project to the Arrow Electric Company for $5,654.20 <br />subject to approval of Conrail. A letter of approval has now <br />been received from Conrail. The letter had been reviewed by the <br />Legal Department and approval is recommended. Upon motion made <br />by Mr. McMahon, seconded by Mr. Brunner and carried, the Board <br />approved the acceptance letter from Conrail and the contract <br />with Arrow Electric Company for the Western Avenue Viaduct Lighting <br />project. The Performance Bond for the project was filed. <br />
