REGULAR MEETING <br />MAY 2, 1977 <br />FILING OF ASSESSMENT ROLL - VACATION RESOLUTION NO. 3439 <br />Patrick PZ. McM.alion, Civil City Engineer, files an assessment <br />roll for the vacation of the first east -west alley north of <br />VLaSalle Avenue from the east right-of-way line of Hill Street, east <br />to the first north -south alley east of Hill Street, between Hill <br />and St. Louis Streets, situated between Lots 124 and 123, Part <br />of Original Town of Lowell. <br />The following property may be injuriously or beneficially affected <br />by such vacation: <br />Lots 124 and 123, Part of Original Town of Lowell <br />The Board finds that each of said lots have been damaged in the <br />amount of $0.00 and benefited in the amount of $0.00. Upon motion <br />made by Mr. McMahon, seconded by Mr. Mullen and carried, the <br />Assessment Roll was filed and set for public hearing on May 23, 1977. <br />COMPLAINT REGARDING EASEMENT BEHIND 4900-5000 MAYFAIR PLACE <br />Councilman Walter Kopczynski transmitted to the Board a letter from <br />James Gore, Jr., 5015 Mayfair Place, calling attention to the fact <br />that an easement located north of property in the 4900 and 5000 <br />block Mayfair Place and the south boundary of the Carlyle Nursing <br />Home is being used as an alleyway for vehicles. This easement <br />was never dedicated as an alley and Mr. Gore said it should not be <br />used for that purpose. He requested that a barrier be erected <br />at Summit Place and the western end of the easement. Mr. McMahon <br />noted that Pie had driven through the area and that there are trash <br />and garbage cans in the easement and apparently cars and trucks do <br />use the easement. It would appear that some property owners are <br />using the easement and the Carlyle Nursing Home is providing <br />access to their rear parking lot from this easement. Mr. McMahon <br />said the Board could investigate the possibility of having the <br />easement dedicated as an alley or they could issue a cease and <br />desist order to stop use of the easement and put up barriers. He <br />said he would suggest that the property owners be advised that this <br />matter has been brought to the Board's attention and ask for their <br />written comments. Mr. McMahon made a motion that the letter be filed <br />and a letter be sent to all affected property owners advising them <br />that the Board can pursue dedication of the easement as a public alley <br />or can issue a cease and desist order to stop use of the alley and <br />erect barricades. The property owners will be asked to make their <br />views known to the Board in writing. The Board will make a decision <br />on the matter based upon the wishes of the majority of the property <br />owners. Mr. Mullen seconded the motion and it carried. <br />REQUEST FOR SIGN ON JEFFERSON STREET PARKING GARAGE <br />The Board received a letter from Nicholas Avgerinos, owner of <br />Kwik Print at 115 E. Jefferson, advising that he would like to <br />continue placement of his sign on the west wall of the Jefferson <br />Street Parking Garage, and, in addition, would like to place a <br />a sign 18 x 18 inches on the corner of St. Joseph and Jefferson. <br />Mr. McMahon noted that the sign on the west wall is approximately <br />2 ft. x 3 ft and is on the wall at this time. Upon motion made by <br />Mr. McMahon, secnded by Mr. Mullen and carried, the request was <br />referred to the Bureau of Traffic and Lighting for review and <br />recommendation. <br />OPENING OF BID FOR STREET DEPARTMENT ROLLER <br />Mr. McMahon reported that a bid for Street Department equipment <br />postmarked in South Bend on April 30 and delivered to the County -City <br />Building this morning but delayed in its delivery to the Board has <br />now been received. Upon motion made by Mr. McMahon, seconded by <br />Mr. Brunner and carried, the bid was opened and publicly read: <br />
