REGULAR MEETING <br />IIARCH .21, 1977 <br />ESCROW AGREEIIENT WITH OLD FORT SUPPLY CO11PANY APPROVED <br />The Board received an escrow agreement for the contract between <br />the City and Old Ford Supply Company for Century Center. Mr, <br />Mcilahon explained that this agreement is similar to other escrow <br />agreements approved by the Board and provides that the City put <br />retainage from the contract into an escrow account so it draws <br />interest. Upon motion made b17 11r. 11c1lahon, seconded by 11r. <br />Mullen and carried, the agreement was approved. <br />APPROVAL OF . CLAIIIS <br />Walter F. Lantz, Deputy City Controller, and Ilichael L. Vance, <br />Deputy City Auditor, submitted to the Board claim docket numbers <br />4239 through 4599 and recommended their approval. Upon notion <br />made by 11r. McMahon, seconded by 11r. Mullen and carried, the Board <br />approved claim docket numbers 4239 through 4599 and directed that <br />checks for payment be issued. <br />AGREEIIE:NT - CITY OF SOUTH BEND AND IIIDIA14A STATE HIGHWAY COPIMISSION <br />FOR EASEMENT AT CENTURY CENTER PROPERTY <br />An Agreement between the City of South Bend and the. Indiana State` <br />Highway Cormiission regarding an easenent at the Century Center <br />property on St. Joseph Street, between Wayne and Colfax, was <br />submitted to the Board. rIr. licklahon explained that this agreement <br />was prepared at the request of the City by the Indiana State <br />Highway Corm.iission. Georgia Luks, Deputy City Attorney, has <br />reviewed the agreement and recommends approval. Upon notion made <br />by Mr. 11c1lahon, seconded by Mr. 11ullen and carried, the Board <br />approved the agreement and it will be submitted to the state for <br />execution. <br />COMPLAINT RE: TRASH BILLING FOR CLEAN-UP OF 234 E. INDIANA <br />Vernon Smits was present and advised the Board that he was billed <br />for city clean-up of trash at property at 234 E. Indiana Avenue. <br />11r. Smits said, during the period of the heavy snow, there was a <br />two -week interval when trucks could not get through for trash pick-up. <br />He said as soon as trucks could get through, he cleaned his lot <br />at 234 E. Indiana. The city clean-up was done on a lot east of <br />234, either at 236 or 238 E. Indiana. 11r. Smits. said he talked <br />to the Water Works and to an Environmental Officer regarding this <br />bill and said he is not going to pay for the clean-up of someone <br />else's property. 11r. 11cliahon said the matter would be referred <br />to the Environnental Protection Office for a review of the exact <br />property which was cleaned b,T the City. If that report indicates <br />the property cleaned was not 11r. Smits property at 234 E.
