INDIANA 46601-1830 <br />Linda DeCicco <br />515 Benton St. <br />Mishawaka, IN 46545 <br />O�SOUTFI,& <br />«.865..;u�` <br />CITY OF SOUTH BEND PETE BUTTIGIEG, MAYOR <br />BOARD OF PUBLIC WORKS <br />November 8, 2016 <br />RE: Encroachment into Public Right -of -Way — 828 Park Ave. <br />Dear Ms. DeCicco: <br />PHONE 574/235-9251 <br />FAx 574/235-9171 <br />The Board of Public Works, at its meeting held on November 8, 2016, approved your request <br />for the installation of an historical marker marking the birthplace of poet Kenneth Rexroth in <br />the tree lawn at 828 Park Avenue subject to you working with the Historic Preservation <br />Society on a smaller design and the installation of the sign be parallel with the street and <br />sidewalk and centered in the tree lawn. The Building Department requires the sign not exceed <br />four (4') feet in height above grade and must stay ten (10') feet away from any driveway <br />unless the sign is three (3') feet or less above grade per S172 Zoning. Enclosed please find a <br />copy of the permit. <br />The encroachment will be permitted to remain and continue until such time as the Board of <br />Public Works of the City of South Bend shall determine that such encroachment is in any way <br />impairing or interfering with the highway or with the free and safe flow of traffic thereon. <br />Said encroachment shall not in any way prejudice or preclude the City's rights with respect <br />to the future use of that portion of the right-of-way. <br />If you have any further questions regarding this matter, please call this office at (574) 235- <br />9251. <br />Sincerely, <br />Leda M.
