Fisher <br />1921 Catalpa <br />South Bend, Indiana <br />AUGUST 31, 1981 <br />The following bids were <br />$605.00 <br />610.00 <br />Upon a motion made by Mr. Kernan, seconded by Mr. Hill and carried, <br />the high bid of Clem S. Fisher in the amount of $610.00 was accepted <br />and the matter referred to the Legal Department for drafting of the <br />necessary purchase agreement. <br />VACATION RESOLUTION NO. 3512, 1981 - CONFIRMED (LUDWICK GRAPHICS) <br />This was the date set for holding a public hearing on Vacation Resolu- <br />tion No. 3512, 1981, for the vacation of the first alley southwest of <br />LaPorte Avenue running northwesterly from Sancome Avenue; thence <br />southwesterly to Wilbur Street, all being in Davis Plat to the City <br />of South Bend, St. Joseph County, Indiana. The Clerk tendered proofs <br />of publication of notice in the South Bend Tribune and the Tri-County <br />News which were found to be sufficient. It was noted that a notice <br />had been sent to all property owners in the vicinity of the proposed <br />vacation and letters had been received from the various city agencies <br />indicating that there was no objection to the proposed vacation. Mrs. <br />Selma Derda, 642 Sancome Street, stated that,'until this time, she <br />had been under the impression that part of the alley in question had <br />already been vacated. She stated that she would object to the vacation <br />of this alley, on behalf of her daughter, Mrs. Violet Gorski, 705 <br />LaPorte Avenue, if part of her daughter's°property would be taken <br />or she would experience access problems. Mr. Leszczynski explained <br />to Mrs. Derda that no property would be taken from Mrs. Gorski but, <br />in fact, Mrs. Gorski would receive seven feet of the fourteen -foot <br />alley where it abutted her property. Mr. Ronald Karmolinski, Mrs. <br />Gorski's son, stated that one of his mother's buildings was located <br />on the property line. He stated that curbing had been put in by the <br />city and the property marker was in the middle. Mr. Leszczynski ° <br />stated that the property iron would mark the alley and would be <br />correct. Mr. Karmolinski stated that, as long as Mrs. Gorski would <br />retain a part of the alley for access, he would have no objection to <br />the alley vacation. Mr. Leszczynski noted that Councilman Walter <br />Szymkowiak had expressed his support for the vacation. Upon a <br />motion made by Mr. Leszczynski, seconded by Mr. Hill and carried, <br />the Board confirmed the Vacation Resolution and ordered preparation <br />of the Assessment Roll to be filed on September 14, 1981. <br />APPROVE ASSESSMENT ROLL - VACATION RESOLUTION NO. <br />3510, 1981 (LOUIE'S`TUX SHOP) <br />This being the date set, hearing was held on the Assessment Roll <br />with respect to Vacation Resolution No. 3510, 1981, for the vacation <br />of the first alley south of Lincolnway West, running westerly from <br />Chapin Street (Inner Belt), to a line that is produced by extending <br />the west property line of Lot 8 in Kunstman's Addition north to the <br />southwest corner of Lot 5 in said Subdivision for a distance of <br />270 feet more or less, all being in Kunstman's Addition to the City <br />of South Bend, St. Joseph County, Indiana. The Clerk tendered proofs <br />of publication of notice in the South Bend Tribune and the Tri.-Couuty <br />News which were found to be sufficient. The Assessment Roll lists <br />$0.00 net benefits and $0.00 net damages to abutting properties. No <br />written remonstrances were filed with the Board and no remonstrators <br />were present. Upon a motion made by Mr. Hill, seconded by'Mr. Kernan <br />and carried, the Assessment Roll was approved and said resolution is <br />in all things ratified and confirmed and said proceedings closed., Mr. <br />Hill noted that the Legal Department would prepare an easement on <br />behalf of Louie's Tux Shop in favor of Mr. and Mrs. Hartie Blake, <br />which easement is a stipulation,of the vacation as ordered by the <br />Board at its meeting held on July 27, 1981. <br />L- <br />1 <br />
