229 <br />REGULAR 14EETING MAY 31, 1983 <br />The regular meeting of the Board of Public Works was convened <br />at 9:35 a.m, on Tuesday, May 31, 1983, by President John E. <br />Leszczynski, with Mr. Leszczynski, Mr. Richard L. Hill and <br />Mr. Joseph E. Kernan present. Also present was Assistant <br />City Attorney Carolyn V. Pfotenhauer. <br />AGENDA ITEM ADDED <br />Upon a motion made by Mr. Leszczynski, seconded by Mr. Hill <br />and carried, a request to conduct a block party on North <br />Adams Street was added to the. agenda. <br />MINUTES OF PREVIOUS 14EETING APPROVED <br />Upon a motion .made by Mr. Kernan, seconded by Mr. Hill and <br />carried, the minutes of the May 23, 1983, regular meeting <br />of the Board were approved. <br />ADOPTION OF RESOLUTION NO. 14-1983 - ESTABLISHMENT <br />OF MAXIMUM CABLE TELEVISION RATES <br />Ms. Carolyn V. Pfotenhauer.advised the Board that under the <br />recently enacted cable television.franchising ordinance, the <br />Board of Public Works is required to establish maximum <br />charges which cable television systems can charge for service. <br />Resolution No. 14-1983 establishes those maximum amounts and <br />the amounts are the same as the existing amounts being charged <br />by Indiana Cablevision Corporation. The existing rates were <br />reviewed and revised in June of 1982. She further advised <br />that there are two (2) additional charges which indicated <br />that a maximum rate of $15.00 be established for the installa- <br />tion of any additional service subsequent to the installation <br />of basic .service and a maximum monthly rate of $2.50 be <br />established for monthly FM service charge. She reiterated <br />that the existing rates are the same as the maximum rates <br />established by this resolution. Upon a motion made by Mr. <br />Hill, seconded by Mr. Kernan and carried, the following <br />Resolution No. 14-1983 was adopted: <br />RESOLUTION NO. 14-1983 <br />WHEREAS, Chapter 7, Article 1, of the South Bend <br />Municipal Code regulates the franchising of cable <br />television system by the City of South Bend; and <br />WHEREAS, said Chapter and Article require that the <br />Board of Public Works establish maximum rates which <br />may be charged to subscribers for services by a cable <br />television system franchise thereunder; and <br />WHEREAS, the maximum rates currently approved by the <br />Board of Public Works which may be charged by Indiana <br />Cablevision Company for certain services were reviewed <br />and revised in June, 1982; and <br />WHEREAS, certain additional services have been added <br />by Indiana Cablevision for which maximum rates must be <br />established. <br />BE IT THEREFORE RESOLVED that the current maximum rates <br />for certain services approved by the Board for use by <br />Indiana Cablevision under its existing franchise be <br />adopted as the maximum rates chargable for said services <br />by a television franchisee pursuant to Chapter 7, Article 1 <br />of the South Bend Municipal Code and that a maximum rate of <br />$15.00 be established for the installation of any additional <br />service subsequent to the installation -of basic service, <br />and a maximum monthly rate of $2.50 be established for <br />monthly FM service charge. A copy of the existing rates <br />and newly established rates is attached to and made a <br />part of this resolution. <br />
