e0 REGULAR MEETING APRIL 18, 1983 Quarter of Section 12, Township 37 North, Range 2 .East, in South Bend, Indiana extending from the South right-of-way line of Colfax Avenue, Southerly to the St.. Joseph River as conveyed to the Municipal City of South Bend, Indiana in Deed Record Book 671, page 428, in the office of the Recorder of St. Joseph County, Indiana and being more particularly described as follows, viz: Beginning at a point on the South right-of-way line of Colfax Avenue, 167.60 feet North 890-54'-00" West of its intersection with the West right-of- way line of Niles Avenue; thence South 40-50'-43" East, a distance of 411.17 feet to a point on the North right-of-way line of Washington Street,, 132.00 feet North 890-47'-15" West from the Southeast corner of lot forty-eight (48) in the Original Plat to -.the Town of Lowell, now City of South Bend; thence South 360-45'-32 East, a distance of 103.30 feet to the South right-of-way line of said Washington Street; thence South 30-57'-43" East, a distance of 293.37 feet to the Easterly meander line of the St. Joseph River; thence North.520-05'-45 West, along said Easterly meander line, a distance of 193.58 feet; thence North 520-57'-51" East, a distance of 32.89 feet; thence North 30-12'-46" E-ast, a distance of 8.90 feet; thence North 30-34-50" West, a distance of 228.50 feet to the South right-of-way line of Gintz Avenue; thence North 50-27'-44" West, along the Easterly right-of-way line of said Gintz Avenue, a distance of 137.81 feet; thence North 50-53'-22" West, along said Easterly right-of-way line, a distance of 274.46 feet to a point on said South right-of-way line of Colfax Avenue 232.26 feet North 890-54'-00" West of its intersection with said West right-of-way line of Niles Avenue, thence South 890-54'-00" East, along said South right-of-way line, a distance of 64.66 feet to the.point of beginning. Subject to any easements, covenants, or restrictions of record. WHEREAS, the Board of Park Commissioners of the Park District of the City of South Bend determined that the acquisition of=the parcel of real-estate referred to as Parcel IV EAST RACE was of public utility and benefit to the citizens and property in the Park District of the City of South Bend, Indiana on the 30th day of December, 1980; and WHEREAS, I.C. 36-1-11-8 provides that a transfer or exchange :of property may be made with a governmental entity upon the terms and conditions agreed upon by the entities as evidenced by adoption of a substantially identical resolution by each entity; and WHEREAS; the Board of Public Works of the City of South Bend desires to transfer that portion of Parcel IV - EAST RACE described herein to the Board of Park Commissioners of the Park District of the City of South Bend for utiliza- tion by said Board for park purposes; and WHEREAS, the Board of Park Commissioners of the Park District of the City of South Bend on May 17, 1982, adopted a resolution determining to acquire said property from the City of South Bend by a transfer of title to the Board of Park Commissioners; and 1
