`c3J <br />REGULAR MEETING MARCH 7, 1983 <br />Perry also reiterated Mr. Blackmonds' comments and asked the <br />Board to defer action until Dr. Bowes' Order can be tested. <br />Mr. Robert Canfield, J.M.S. Building, Suite 707, attorney <br />for his brother, Mr. David J. Canfield, 1891 Riverside <br />Drive, expressed his support of the action requested by <br />attorneys Blackmond and Perry. <br />Mr. David J. Canfield, 1891 Riverside Drive, addressed the <br />Board. -and stated that every effort should be made to assist <br />the individual having the problem on Riverside Drive. He <br />suggested that it would be in the City's best interest to <br />look into other solutions available short of the sanitary <br />sewer project to correct this one problem. <br />Mr. Fritz`Marti, 1869 Riverside Drive addressed the Board <br />and stated that he has lived at his residence since 1976 <br />and has a perfectly working septic system and does not need <br />the new sanitary sewer project. He stated that he has had <br />his system repumped, it works perfectly, he does not want <br />to be assessed and he does not need the sewer project. <br />Mr. Hill asked Attorney Don G. Blackmond the basis of the <br />statement in the remonstrance indicating that no proper <br />legal notice was given to the affected property owners <br />regarding the public hearing scheduled for March 7, 1983. <br />Mr. Blackmond stated that at the time the remonstrance was <br />prepared, he was under the impression that proper notice <br />was not given but now stands corrected on that matter. <br />There being no one else present wishing to address the <br />Board on this matter, upon a motion made by Mr. Leszczynski, <br />seconded by Mr. Hill and carried, the public hearing on the <br />Riverside Drive and Riverside Place Sanitary Sewer Project <br />was closed. <br />Upon a motion made by Mr. Hill, seconded by Mr. Kernan and <br />carried, the Board will defer proceeding with the project <br />until the outcome of the litigation is determined. Mr. <br />Leszczynski asked for the assistance of both the Board and <br />the affected property owners in vigorously pursuing to <br />resolve this matter as quickly as possible. <br />ADOPTION OF RESOLUTION NO. 3-1983 - DISPOSE OF <br />OBSOLETE EQUIPMENT (STREET DEPARTMENT) <br />RESOLUTION NO. 3-1983 <br />WHEREAS, it has been determined by the Board of <br />Public Works that the following street sweepers are <br />obsolete and deteriorated to the point where repair <br />costs would exceed their value: <br />Bureau of Strests - 1973 Elgin Pelican Sweeper <br />Serial No. S2742S <br />1975 Elgin Pelican Sweeper <br />Serial No. S1961S <br />WHEREAS, Indiana Code 36-1-11-6 permits the sale of <br />personal property no longer needed or obsolete. <br />NOW, THEREFORE, BE IT RESOLVED by the Board of Public <br />Works of the City of South Bend that the Elgin street <br />sweepers listed above are obsolete and not needed by <br />the City of South Bend. <br />
