Bid was signed by Harlan A. <br />645 Wilber Street Lusk, President, Non -collusion <br />South Bend, Indiana affidavit was in order and a <br />5% bid bond was submitted. <br />TOTAL AMOUNT OF BID: $892866.00 <br />Upon a motion made by Mr. Leszczynski, seconded by Mr. Hill and <br />carried, the above bids were referred to the City Engineer's <br />Office for review and recommendation. <br />CONTINUATION OF PUBLIC HEARING - IMPROVEMENT RESOLUTION <br />NO. 3519-1983 (SOUTH BEND AVENUE SANITARY SEWER PROJECT) <br />Mr. Leszczynski stated that this was the date set for the <br />continuation of the public hearing on Improvement Resolution <br />No. 3519-1983 for the construction of sanitary sewers on South <br />Bend Avenue from Edison Road to approximately 300 feet northeast <br />of Charles Street. <br />Mr. Leszczynski stated that in an unplatted area, the number of <br />(� lots to be included in the total assessment is determined by <br />dividing the total front footage of the property abutting the <br />Q works by 100 feet and the rounding up to the nearest whole <br />number. He additionally stated that this formula is based <br />on state statute and the Board does not have any flexibility <br />in computing the assessments. Carolyn V. Pfotenhauer, Board <br />Attorney, read Indiana Code 36-9-21-8 and advised that this. <br />is the state statute used in computing assessments for sewage <br />works. <br />Mr. Charles L. Watson who resides at 51792 West Gatehouse <br />Drive and owns property at 1724 South Bend Avenue appeared <br />before the Board and questioned the computation of his assess- <br />ment. He stated that he has one building on one lot with only <br />one access but is being assessed for two (2) lots. He stated <br />that his lot is being used commercially and cannot be divided. <br />Mr. Carlo Anastasio, 17577 State Road 23, also stated that <br />his situation is identical to that of Mr. Watson and he too <br />would like a clarification of how the assessment was made <br />The Board informed Mr. Watson and Mr. Anastasio that the <br />Board attorney would look into the matter and would be in <br />contact with them with a clarification of the assessment. <br />Upon a motion made by Mr. Leszczynski, seconded by Mr. Kernan <br />and carried, the Public Hearing on this matter was closed. <br />Further, upon a motion made by Mr. Leszczynski, seconded by <br />Mr. Kernan and carried, the South Bend Avenue Sanitary Sewer <br />Project was approved and authorized to proceed. <br />PUBLIC HEARING - IMPROVEMENT RESOLUTION NO. 3518-1983 <br />(RIVERSIDE DRIVE AND RIVERSIDE PLACE SANITARY SEWER PROJECT <br />Mr. Leszczynski stated that as authorized under Improvement <br />Resolution No. 3518-1983, adopted by the Board on February <br />14, 1983, this was the date set for the public hearing on <br />said Resolution for the construction of sanitary sewers on <br />Riverside Drive and Riverside Place. The Clerk tendered <br />proofs of publication of notice in the South Bend Tribune <br />and the Tri-County News which were found to be sufficient. <br />It was noted that the Preliminary Assessment Roll indicates <br />that the total cost of the Improvement is $89,353.85 with <br />the amount assessed to the City being $57,177.01 and the <br />balance being assessed accordingly to affected property <br />owners. <br />
