55 <br />REGULAR MEETING NOVEMBER 29, 1982 <br />The following proposals were received after the 9:30 a.m. <br />legally-advertised.deadline: <br />Transamerica Occidental Life <br />Box 2101 <br />Los Angeles, California 90051 <br />Health Claims Administration, Inc. <br />20 East Cass Street <br />Joliet, Illinois 60431 <br />The Prudential Insurance Co..of America <br />Suite 934 <br />120 S. Riverside Plaza <br />Chicago, Illinois 60606 <br />It was noted that the legal notice which was published specified <br />a 9:30 a.m, deadline for receipt of the proposals. Mrs. <br />Pfotenhauer stated that, in light of the four -day Thanksgiving <br />holiday which had preceded the proposal opening date, and the <br />fact that three of the proposals had been mailed well in advance <br />of the deadline, the Board might want to consider waiving the <br />deadline requirement. Mr. Hill expressed concern that bidders <br />in the future may feel the deadline requirement can easily be <br />waived, and he wanted to caution against that. He agreed that, <br />because of the holiday weekend and the vast amount of mail <br />which had to be processed and which had not been completed as <br />of 9:30 a.m., the Board should consider waiving the publication <br />requirements. He pointed out that the requirements for the <br />receipt of proposals was at the Board's discretion and was not <br />mandated by state statutes as was the case when receiving <br />sealed, formal bids. Mr. Kernan felt that it was obvious a <br />mail delay problem occurred simply because three proposals <br />were subsequently received. Upon a motion made by Mr. Hill, <br />seconded by Mr. Kernan and carried, the three proposals <br />received from Transamerica Occidental Life, Health Claims <br />Administration and The Prudential Insurance Company, after <br />the legally -advertised deadline were acknowledged and opened. <br />In view of the complexity of the insurance proposals received <br />and the variables involved in determining coverage and rates <br />in accordance with the prepared specifications, Mr. Leszczyn.ski <br />noted that the proposals would be available for public inspection <br />by any interested person in the Office of the Controller. Mr. <br />Kernan advised that Corporate Policyholders Counsel had <br />concurrently received these proposals in Chicago and would be <br />reviewing them in order to make a recommendation to the Board. <br />He anticipated that the review would be completed and a <br />recommendation submitted to the Board for action at its <br />January 17, 1983, regular meeting. Upon a motion made by Mr.. <br />Hiil, seconded by Mr. Kernan and carried, the above proposals <br />were referred to the Controller's Office. <br />Because of the untimely passing of Laporte's mayor, A. J. <br />Rumely, Mr. Kernan excused himself from the Board meeting at <br />approximately 10:15 a.m., in order to attend the funeral and <br />pay final respects to the mayor on behalf of the City of <br />South Bend. <br />PUBLIC HEARING - APPROVE ALLEY VACATION (GUILFOYLE'S SUBDIVISION <br />Mr. Leszczynski advised that Joyce Hoff, 1652 North Sheridan. <br />Street, and Joseph Shula, 3112 West Sample Street, were <br />petitioning for the vacation of the first north -south, east - <br />west alley south of Western Avenue, running west from Arnold <br />Street for a distance of 92 feet; thence north a distance of <br />80 feet more or less to the south right-of-way of the present <br />12-foot alley, all being in Guilfoyle's Proposed Subdivision <br />of Point of B.O.L. 94 in the City of South Bend. He stated <br />that, as in the past, in order for the Board to submit a <br />recommendation to the Common Council, a public hearing had <br />
