REGULAR MEETING <br />FEBRUARY 13, 1984 <br />RESOLUTION NO. 3-1984 <br />RESOLUTION OF THE BOARD OF PUBLIC WORKS ACCEPTING AN <br />AGREEMENT WITH CONSOLIDATED RAIL CORPORATION FOR USE <br />OF PROPERTY FOR CONSTRUCTION OF STORM DRAINAGE PIPE <br />WHEREAS, The City of South Bend desires to install <br />storm drainage pipe on.property owned by Consolidated Rail <br />Corporation, and <br />WHEREAS, said construction consists of one (1) sixty inch <br />(60") corrugated steel gravity flow storm water pipe, and <br />WHEREAS, said pipe is to be installed through the lands <br />and under and across the roadway and tracks of the Nipsco <br />Branch of Railroad (formerly held by The New York Central <br />Railroad Company) at Valuation Station 148+16.5+, located <br />2,000 feet south of Mile Post 3, at a point 1.82 miles south <br />of the State of Olive Street (South Bend), St. Joseph County, <br />Indiana, and <br />WHEREAS, said Consolidated Rail Corporation has submitted <br />to the City of South Bend a License Agreement for Wire, Pipe <br />and Cable Transverse Crossings and Longitudinal Occupations <br />dated January 10, 1984 naming the City of South Bend as Licensee <br />under the terms of the Agreement, and <br />WHEREAS, said Agreement grants to the City of South Bend <br />authority to construct said drainage pipe in accordance with <br />construction plans dated August 15, 1983, and <br />WHEREAS, said Agreement indicates that Licensee shall pay <br />to the Railroad the sum of two thousand two hundred dollars <br />($2,200.00) as reimbursement for the rights granted in said <br />Agreement, <br />NOW, THEREFORE, BE IT RESOLVED by the Board of Public <br />Works of the City of South Bend that said Agreement be approved <br />and executed. <br />ADOPTED this 13th day of February, 1984. <br />BOARD OF PUBLIC WORKS <br />s/ John E. Parmerlee, Clerk <br />ADOPTION OF RESOLUTION NO. 4-1984 - RECYCLING/TRANSFER STATION <br />LICENSE — SOMETHING OF VALUE, INC. <br />Mr. Leszczynski advised that the Board has received a license applica- <br />tion for a Recycling/Transfer Station license from Something of <br />Value, Inc., 1100 Prairie Avenue, South Bend, Indiana., Mr. <br />Leszczynski further advised that the Fire Department Prevention <br />Bureau inspected the above referred to premises on February 9, 1984, <br />and has forwarded to the Board a favorable recommendation. Addition- <br />ally, the Department of Code Enforcement inspected said premises <br />on February 3, 1984 and advised.that this scrapyard will be a metal <br />recycling center and a fertilizer processing plant. All of the <br />activity will take place inside the building. The Department of <br />Code Enforcement indicated that all of the technical aspects of <br />the ordinance have been met except for the opaque fencing requirement <br />and the need for a buffer strip. Ms. Katherine Barnard, Director of <br />the Department of Code Enforcement advised that it is her recommenda- <br />tion that an opaque fence should not be required since the recycling <br />C <br />L <br />1 <br />
