REGULAR MEETING <br />SEPTEMBER 16, 1985 <br />1 0", <br />1 <br />the JTP Program is in the amount of $3,600.00 and is for the <br />period July 1, 1985 through June 30, 1986. The Agreement further <br />states that the services, up to a maximum of six (6) hours per <br />month, will be available for a fixed fee of $300.00 per month <br />during this period. Legal services exceeding the $300.00 limit <br />may be available at a rate of $50.00 per hour pending the <br />approval of the JTP Board of Directors. Upon a motion made by <br />Ms. Barnard, seconded by Mr. Leszczynski and carried, the <br />Agreement was approved and executed. <br />APPROVE CONTRACTS - CAR WASHES FOR CITY VEHICLES <br />Pursuant to the awardof bids on September 3, 1985 to Hi -Speed <br />Auto Wash, 609 East LaSalle Avenue, South Bend, Indiana and Don's <br />Marathon & Car Wash, 1836 South Michigan Street, South Bend, <br />Indiana, Contracts for said services were submitted to the Board <br />for approval. Upon a motion made by Mr. Leszczynski, seconded by <br />Ms. Barnard and carried, the Contracts were approved and <br />executed. <br />APPROVE AND ACCEPT: <br />1. DEDICATION OF PUBLIC RIGHT-OF-WAY - S.E. CORNER OF <br />PORTAGE AVENUE AND INDIANA TOLL ROAD <br />2. EASEMENT AND RIGHT-OF-WAY (PART OF N.W. QUARTER <br />OF SECTION 27, T. 38 N., R. 2 E. <br />Mr. Kenneth P. Fedder, Attorney -at -Law, 300 First Bank Building, <br />205 West Jefferson Boulevard, South Bend, Indiana, was present on <br />behalf of his client Mr. Numan Amouri. <br />Mr. Fedder stated that Mr. Amouri is in the process of <br />constructing a retail center at the S.E. corner of Portage and <br />Indiana Toll Road. A review of his client's petition by the Area <br />Plan Commission reflected the need for a Dedication of Public <br />Right -of -Way at the S.E. corner of Portage Avenue and the Indiana <br />Toll Road. That document has been prepared and is being <br />submitted to the Board at this time for acceptance and approval. <br />Further, as requested by the City Engineering Department, Mr. <br />Fedder submitted an Easement and Right -of -Way for part of the <br />Northwest Quarter of Section 27, T. 38 N., R. 2 E., German <br />Township, St. Joseph County, Indiana, more particularly described <br />in the legal description contained in the Easement. The parcel <br />of property will be used as an Utility Easement to the City of <br />South Bend for a sanitary sludge line being fifteen feet (15') in <br />width along and adjacent to the entire North line of the <br />property. <br />In response to Mr. Fedder's inquiry of whether a ten foot (10') <br />set -back would be adequate, Mr. Leszczynski advised that the City <br />typically requires a minimum of a fifteen foot (15') setback and <br />in this case those requirements would be necessary. <br />Upon a motion made by Mr. Leszczynski, seconded by Ms. Barnard <br />and carried, the above referred to documents were accepted and <br />approved. <br />ADOPTION OF RESOLUTION NO. 21-1985 - DISPOSAL OF OBSOLETE <br />VEHICLES (POLICE AND FIRE DEPARTMENTS) <br />The following Resolution No. 21-1985 authorizes the disposal of <br />vehicles at a public auction which will be held on October 5, <br />1985 at 9:00 a.m. in the parking lot behind the Central Police <br />Station at 701 West Sample Street. The vehicles to be disposed <br />of are from the Police Department and Fire Department fleets and <br />are no longer fit for service within those departments. It was <br />noted that forty-seven (47) of the vehicles are from the Police <br />Department and four (4) are from the Fire Department. Upon a <br />motion made by Ms. Barnard, seconded by Mr. Leszczynski and <br />carried, the following Resolution was adopted: <br />
