REGULAR MEETING

<br />Mrs. Clementine Billisitz, 522 South Grant Street, South Bend,
<br />Indiana, Petitioner, was present and advised the Board that<she,_.is.
<br />in favor of the alley vacation. She further stated that all but
<br />one of the property owners who have garages that abut the alley
<br />are in favor of the vacation.
<br />Mr. and Mrs. Richard Geyer, 313 East South Street, South Bend,
<br />Indiana, were present and advised that they recently purchased the
<br />property at 518 Grant Street and are also in favor of the proposed
<br />alley vacation. In response to Mr. Geyer's inquiry of whether or
<br />not the City would put in a curb should the alley be vacated, Mr.
<br />Leszczynski advised that the City would not.
<br />Mr. Leszczynski stated.that the Board has received a letter from
<br />Mrs. Lorraine Maerjern, 714 South Liberty Street, South Bend,
<br />Indiana, daughter of Mr. and Mrs. Everett Wright, Healthwin
<br />Hospital, 20531 Darden Road, South Bend, Indiana. Ms. Maerjern
<br />indicated that the property at 521-523 South Brookfield Street.,
<br />South Bend, Indiana has been turned over to her by her parents and
<br />she is in the process of selling it to meet expenses. She advised
<br />that she does not want the alley to be vacated. She further
<br />advised that it is the desire of her parents that the alley not be
<br />vacated.
<br />Mr. Leszczynski further stated that the board has received a
<br />letter from Mrs. Stanley Prebys, 616 East Angela Boulevard, Southl
<br />Bend, an abutting property owner, indicating that she is in favor_
<br />of the proposed vacation.
<br />There being no one else present wishing to speak either for or
<br />against the proposed alley vacation, upon a motion made by Mr.
<br />Leszczynski, seconded by Ms. Barnard and carried, the Public
<br />Hearing on this matter was closed.
<br />To summarize, Mr. Vance indicated that it appears that of the four
<br />(4) property owners directly involved, three (3) are in favor of
<br />the vacation and one (1) is against.
<br />Ms. Barnard stated that she has some concerns regarding this
<br />proposed vacation and would recommend that the Board continue this
<br />matter until June 24, 1985, in order to give Board members an
<br />opportunity to inspect the.site of the proposed alley vacation.

<br />Therefore, upon a motion made by Ms. Barnard, seconded by Mr.
<br />Vance and carried, the matter of the above referred to proposed
<br />alley vacation was continued until the next regular meeting of.the
<br />Board.
<br />PUBLIC HEARING AND RECOMMENDATION - ALLEY VACATION: 1ST E/W ALLEY
<br />NORTH OF LA SALLE STREET RUNNING EAST FROM MAIN STREET
<br />Mr. Leszczynski advised that this was the date set for the Board's
<br />Public Hearing on a proposed alley vacation described as the 1st
<br />east/west alley north of LaSalle Street.running east from.Main.
<br />Street to the north -south alley for a_ distance of 165 (one -hundred
<br />sixty-five), feet lying between Lots 173 and 174 of the original
<br />plat of the City of South Bend, St. Joseph County, Indiana.
<br />It was noted that this Public Hearing is being held in order for
<br />the Board to submit a recommendation to the Common Council
<br />concerning the Vacation Petition filed by Mr. Dave Gordan, on
<br />behalf of The Burger King Corporation, BK Limited Partnership II,
<br />P.O. Box 520783, Mail Station: 1790, Miami, Florida. It was
<br />further noted that pursuant to South Bend Municipal Code Section
<br />18.53.8, owners whose property abut the proposed alley to be
<br />vacated were notified of the Board's Public Hearing date.
<br />Mr. Bill Pagel, 120 West LaSalle Avenue, South Bend, Indiana,
<br />representing Burger King Corporation was present and addressed the
<br />Board. Mr. Pagel asked that the Board favorably consider the
