R <br />REGULAR MEETING <br />JANUARY 7, 1985 <br />stated that should this alley vacation receive a favorable <br />recommendation from the Council, he is prepared to file a Petition <br />for Rezoning which will be required for Mr. Kruk to expand his <br />service station. <br />There being no one else present wishing to speak either for or <br />against the above referred to proposed alley vacation, and no <br />written objections having been filed with the Board, upon a motion <br />made by Mr. Leszczynski, seconded by Mr. Hill and carried, the <br />public hearing on this matter was closed. <br />Mr. Vance advised that after reviewing the Petition and diagram of <br />the alley to be vacated, it appears that for safety reasons it <br />would be a good idea to move the alley from the corner. Mr. Kruk <br />reiterated that he has agreed to dedicate a new right-of-way for a <br />new improved alley and will incur the expense of improving the new <br />alley. <br />There being no further discussion concerning this matter, upon a <br />motion made by Mr. Vance, seconded by Mr. Leszczynski and carried, <br />the Clerk was instructed to forward to the Common Council a <br />favorable recommendation on this proposed alley vacation <br />contingent upon the dedication of additional right-of-way for a <br />new alley to be the east -sixteen (16) feet of Lot 7, with the cost <br />of improving the new alley to be incurred by Mr. Kruk and subject <br />to any and all utility easements. <br />ADOPTION OF RESOLUTION NO. 1-1985 - SCRAP/JUNK/RECYCLING DEALER <br />LICENSES FOR 1985 <br />Mr. Leszczynski advised that the Board has received renewal <br />license applications from eighteen (18) area scrap/junk and <br />recycling dealers for 1985. Inspections of the operations were <br />conducted by the Department of Code Enforcement and the Fire <br />Department Prevention Bureau. <br />Ms. Katherine Barnard, Director, Department of Code Enforcement, <br />was present and addressed the Board. Ms. Barnard advised that of <br />the eighteen (18) renewal license applications received, seventeen <br />(17) have complied with the requirements of the Department of Code <br />Enforcement and the Fire Prevention Bureau. The one dealer not in <br />compliance, Super Auto Salvage Company, Inc., 3300 South Main <br />Street, South Bend, Indiana, was given until January 11, 1985 to <br />comply with code enforcement requirements by making needed <br />repairs to the fence on the premises. <br />There being no further discussion concerning this matter, upon a <br />motion made by Mr. Hill, seconded by Mr. Leszczynski and carried, <br />Resolution No. 1-1985 recommending Council approval of license <br />renewals for the following scrap/junk/recycling dealers was <br />adopted and the Clerk was instructed to prepare the necessary <br />Common Council resolution for final action by the Council at their <br />meeting to be held on January 14, 1985. Resolution No. 1-1985 is <br />as follows: <br />RESOLUTION NO. 1-1985 <br />WHEREAS, license renewal applications for scrap/junk/and <br />recycling dealers for the year 1985 have been received by the <br />Board of Public Works; and <br />WHEREAS, inspections of the properties have been completed by <br />the Department of Code Enforcement and the Fire Prevention Bureau <br />as required by Chapter 4, Article 4, Section 4-51 of the Municipal <br />Code; and <br />
