REGULAR MEETING <br />JULY 15, 1986 <br />The regular meeting of <br />9:32 a.m. on Tuesday, <br />Leszczynski, with Mr. <br />Barnard present. Also <br />Thomas Bodnar. <br />the Board of Public Works was convened at <br />July 15, 1986, by President John E. <br />Leszczynski, Mr. Vance and Ms. Katherine G. <br />present was Chief Deputy City Attorney <br />AGENDA ITEM STRICKEN AND NEW ITEMS ADDED <br />Upon a motion made by Mr. Vance, seconded by Ms. Barnard and <br />carried, the following agenda item was stricken and new items <br />added: <br />STRICKEN <br />1. Loan Agreement - Container Services Corporation <br />ADDED: <br />1. Minutes of previous meeting <br />2. Request to advertise for the receipt of bids - State <br />Theatre Re -Roofing and Miscellaneous Repairs Project <br />3. Title Sheet - State Theatre Project <br />APPROVE MINUTES OF PREVIOUS MEETING <br />Upon a motion made by Mr. Leszczynski, seconded by Mr. Vance, and <br />carried, the minutes of the July 8, 1986, regular meeting of the <br />Board were approved. <br />PUBLIC HEARING AND FAVORABLE RECOMMENDATION - ALLEY VACATIONS: <br />1ST N/S ALLEY E. OF WILLIAM FROM WESTERN AVENUE AND 1ST E/W ALLEY <br />SO. OF WESTERN FROM WILLIAM <br />Mr. Leszczynski advised that this was the date set for the <br />Board's Public Hearing the proposed alley vacations described as <br />follows: <br />The first north/south alley East of William Street, from <br />Western Avenue, South to the South line of Lots 6 and 14, <br />Vail's Southwest Addition, Block 8; and <br />The first east/west alley south of Western Avenue, from <br />William Street east to the East line of Lots 12 and 13, <br />Vail's Southwest Addition, Block 8. <br />It was noted that this Public Hearing is being held in order for <br />the Board to submit a recommendation to the Common Council <br />concerning the Vacation Petition filed by Van E. Gates, 401 South <br />Lafayette Street, South Bend, Indiana. It was further noted that <br />pursuant to South Bend Municipal Code Section 18-53.8, owners <br />whose property abut the proposed alleys to be vacated were <br />notified of the Board's Public Hearing date. <br />Mr. Van Gates, Petitioner and Mr. James M. Miller, Attorney at <br />Law, 107 Lafayette Building, South Bend, Indiana, addressed the <br />Board regarding the proposed vacation. <br />Mr. Gates stated that the vacation is requested as the Stanley <br />Coveleski Stadium Project has crowded things due to the fact that <br />the City has acquired from him approximately 80,000 square feet <br />of property for the stadium project. Mr. Gates submitted to the <br />Board a diagram indicating the lots that were sold to the City <br />for the stadium project. Mr. Gates further advised that he has <br />spoken to Ritchy's at 416 Western Avenue, an abutting property <br />owner, and they are not opposed to the vacation of the alley as <br />proposed. Mr. Miller, utilizing the map submitted with the <br />Vacation Petition, showed the Board the location of the proposed <br />alleys to be vacated. Mr. Gates further stated that the vacation <br />is needed in order to maintain security of his property as well <br />as storage of the vehicles of Gates Chevrolet Corporation doing <br />business as Gates Chevy World at 401 South Lafayette Street. <br />
