REGULAR MEETING JUNE 17, 1986 <br />The regular meeting of the Board of Public Works was convened at <br />9:36 a.m. on Tuesday, June 17, 1986, by President John E. <br />Leszczynski, with Mr. Leszczynski, Ms. Katherine G. Barnard <br />and Mr. Michael L. Vance present. Also present was Chief Deputy <br />City Attorney Thomas Bodnar. <br />AGENDA ITEM ADDED <br />Upon a motion made by Mr. Vance, seconded by Ms. Barnard and <br />carried, a request to advertise for the receipt of bids for <br />one (1) van mounted aerial lift was added to the agenda. <br />APPROVE MINUTES OF PREVIOUS MEETING <br />Upon a motion made by Mr. Leszczynski, seconded by Mr. Vance, and <br />carried, the minutes of the June 10, 1986, regular meeting of the <br />Board were approved. <br />PUBLIC HEARING AND UNFAVORABLE RECOMMENDATION - VACATION OF <br />PORTIONS OF ST. PETER STREET LYING BETWEEN CORBY BLVD. AND <br />NAPOLEON STREET <br />Mr. Leszczynski advised that this was the date set for the <br />Board's Public Hearing on the proposed vacation of portions of <br />St. Peter Street lying between Corby Blvd., and Napoleon more <br />particularly described as follows: The east 8.25 feet and the <br />west 8.25 feet of said Public way, from Corby Blvd. to Napoleon <br />for a combined total distance of 594 feet more or less all being <br />in the City of South Bend, Indiana, Sorins 2nd Add. to the town <br />of Lowell. <br />It was noted that this Public Hearing was being held in order for <br />the Board to submit a recommendation to the Common Council <br />concerning the Vacation Petition signed by eighteen (18) <br />residents of the area affected. It was further noted that <br />pursuant to South Bend Municipal Code Section 18-53.8, owners <br />whose property abut the proposed property to be vacated were <br />notified of the Board's Public Hearing date. <br />Mr. Henry Hoover, Attorney at Law, 505 J.M.S. Building, South <br />Bend, Indiana, appeared before the Board on behalf of the Order <br />Of St. Matthew, Genisis Vicariate, 723 Howard Street, South Bend, <br />Indiana, a Petitioner, in this property vacation. <br />Mr. Hoover stated that the Petition requests that the <br />right-of-way of St. Peter Street from Corby to Napoleon, a <br />distance of three (3) blocks, be narrowed to sixty-six feet <br />(66'). This change would allow construction of an addition to a <br />building owned by the Petitioner, Order of St. Matthew, at Howard <br />and St. Peter Streets. He stated that it was discovered that the <br />addition as proposed would occupy more than 43% of the lot in <br />question. With the vacation of property as proposed, the problem <br />of the addition occupying more than the allowed 40% of the lot <br />would be resolved. He further stated that the vacation of the <br />property would not adversely affect anyone as there would be no <br />changes in the curbs or street but would cause the street to be <br />consistent with the right-of-way south of Corby. <br />Ms. Lillian Caddy, 917 North St. Peter Street, South Bend, <br />Indiana, <br />an abutting property owner, asked why the City was <br />taking away this property. Mr. Leszczynski advised her that no <br />property was being taken away, and should the vacation be <br />approved, property owners would actually acquire property. <br />Ms. Maria Micskey, 803 St. Vincent Street, South Bend, Indiana, <br />another abutting property owner, asked the purpose of the <br />proposed vacation. Attorney Hoover stated that the purpose of <br />the vacation was for the Order of St. Matthew to be able to <br />comply with regulations of the Building Department in regards to <br />
