73 REGULAR MEETING MAY 27, 1986 The regular meeting of the Board of Public Works was convened at 9:39 a.m..on Tuesday, May 27, 1986, by President John E. Leszczynski, with Mr. Leszczynski and Ms. Katherine G. Barnard present. Board member Michael L. Vance was not in attendance. Also present was Chief Deputy City Attorney Thomas Bodnar. AGENDA ITEMS STRICKEN Upon a motion made by Mr. Leszczynski, seconded by Ms. Barnard and carried, the following two (2) items were stricken from the agenda at this time: 1. Resolution No. 11-1986 - Writing -off Uncollectible Department of Code Enforcement Accounts. 2. Recommendation on award of bid for Street Crack Sealing Project (Various Streets throughout the City of South Bend). APPROVE MINUTES OF PREVIOUS MEETING Upon a motion made by Ms. Barnard, seconded by Mr. Leszczynski and carried, the minutes of the May 20, 1986, regular meeting of the Board were approved. PUBLIC HEARING AND FAVORABLE RECOMMENDATION - VACATION OF 1ST E/W ALLEY N. OF PLEASANT ST. RUNNING E. FROM 28TH STREET TO THE 2ND INTERSECTING N/S ALLEY E. OF 28TH STREET Mr. Leszczynski advised that this was the date set for the Board's Public Hearing on a proposed alley vacation described as the 1st east/west alley north of Pleasant Street running east from Twenty-eighth Street to the 2nd intersecting north/south alley east of Twenty-eighth Street, excepting 15' R/W of the 1st intersecting north/south alley east of 28th Street for a combined distance of 265 feet more or less and being in Horne's subdivision of B in the City of South Bend, In. It was noted that this Public Hearing is being held in order for the Board to submit a recommendation to the Common Council concerning the Vacation Petition filed by the following individuals: J. R. Flynn 1112 South 28th Street Glennie Beron 1114 South 28th Street David Splawski 2814 Horne Court Penny K. Stanfield 2818 Horne Court Patrick D. Myers 2813 Pleasant Street Patrick D. Myers 2901 Pleasant Street Harry J. Doyle 2902 Horne Court It was further noted that pursuant to South Bend Municipal Code Section 18-53.8, owners whose property abut the proposed alley to be vacated were notified of the Board's Public Hearing date. Mr. John Flynn, 1112 South 28th Street, South Bend, Indiana, one of the Petitioners, was present and addressed the Board. Mr. Flynn stated that the purpose of the vacation is to improve the neighborhood appearance and safety. He additionally submitted to the Board a letter from Mr. David Splawski, 2814 Horne Court, South Bend, Indiana, stating that he is in favor of the vacation of the alley. Mr. Harry J. Doyle, 2902 Horne Court, South Bend, Indiana, was also present and stated that he is in favor of the vacation. Additionally, Ms. Vera Petri, 2638 Fernway, South Bend, Indiana, was present on behalf of her aunt, Ms. Glennie Beron, 1114 South 28th Street, South Bend, Indiana, and stated that the closing of the alley would be an improvement to the neighborhood.
