73 <br />REGULAR MEETING <br />MAY 27, 1986 <br />The regular meeting of the Board of Public Works was convened at <br />9:39 a.m..on Tuesday, May 27, 1986, by President John E. <br />Leszczynski, with Mr. Leszczynski and Ms. Katherine G. Barnard <br />present. Board member Michael L. Vance was not in attendance. <br />Also present was Chief Deputy City Attorney Thomas Bodnar. <br />AGENDA ITEMS STRICKEN <br />Upon a motion made by Mr. Leszczynski, seconded by Ms. Barnard <br />and carried, the following two (2) items were stricken from the <br />agenda at this time: <br />1. Resolution No. 11-1986 - Writing -off Uncollectible <br />Department of Code Enforcement Accounts. <br />2. Recommendation on award of bid for Street Crack Sealing <br />Project (Various Streets throughout the City of South <br />Bend). <br />APPROVE MINUTES OF PREVIOUS MEETING <br />Upon a motion made by Ms. Barnard, seconded by Mr. Leszczynski <br />and carried, the minutes of the May 20, 1986, regular meeting of <br />the Board were approved. <br />PUBLIC HEARING AND FAVORABLE RECOMMENDATION - VACATION OF 1ST E/W <br />ALLEY N. OF PLEASANT ST. RUNNING E. FROM 28TH STREET TO THE 2ND <br />INTERSECTING N/S ALLEY E. OF 28TH STREET <br />Mr. Leszczynski advised that this was the date set for the <br />Board's Public Hearing on a proposed alley vacation described as <br />the 1st east/west alley north of Pleasant Street running east <br />from Twenty-eighth Street to the 2nd intersecting north/south <br />alley east of Twenty-eighth Street, excepting 15' R/W of the 1st <br />intersecting north/south alley east of 28th Street for a combined <br />distance of 265 feet more or less and being in Horne's <br />subdivision of B in the City of South Bend, In. <br />It was noted that this Public Hearing is being held in order for <br />the Board to submit a recommendation to the Common Council <br />concerning the Vacation Petition filed by the following <br />individuals: <br />J. R. Flynn <br />1112 <br />South <br />28th Street <br />Glennie Beron <br />1114 <br />South <br />28th Street <br />David Splawski <br />2814 <br />Horne <br />Court <br />Penny K. Stanfield <br />2818 <br />Horne <br />Court <br />Patrick D. Myers <br />2813 <br />Pleasant Street <br />Patrick D. Myers <br />2901 <br />Pleasant Street <br />Harry J. Doyle <br />2902 <br />Horne <br />Court <br />It was further noted that pursuant to South Bend Municipal Code <br />Section 18-53.8, owners whose property abut the proposed alley to <br />be vacated were notified of the Board's Public Hearing date. <br />Mr. John Flynn, 1112 South 28th Street, South Bend, Indiana, one <br />of the Petitioners, was present and addressed the Board. Mr. <br />Flynn stated that the purpose of the vacation is to improve the <br />neighborhood appearance and safety. He additionally submitted to <br />the Board a letter from Mr. David Splawski, 2814 Horne Court, <br />South Bend, Indiana, stating that he is in favor of the vacation <br />of the alley. <br />Mr. Harry J. Doyle, 2902 Horne Court, South Bend, Indiana, was <br />also present and stated that he is in favor of the vacation. <br />Additionally, Ms. Vera Petri, 2638 Fernway, South Bend, Indiana, <br />was present on behalf of her aunt, Ms. Glennie Beron, 1114 South <br />28th Street, South Bend, Indiana, and stated that the closing of <br />the alley would be an improvement to the neighborhood. <br />
