REGULAR MEETING APRIL 15, 1986 <br />The regular meeting of the Board of Public Works was convened at <br />9:39 a.m. on Tuesday, April 15, 1986, by President John E. <br />Leszczynski, with Mr. Leszczynski, Ms. Katherine G. Barnard <br />and Mr. Michael L. Vance present. Also present was Chief Deputy <br />City Attorney Thomas Bodnar. <br />APPROVE MINUTES OF PREVIOUS MEETING <br />Upon a motion made by Ms. Barnard, seconded by Mr. Vance, and <br />carried, the minutes of the April 8, 1986, regular meeting of the <br />Board were approved. <br />PUBLIC HEARING AND FAVORABLE RECOMMENDATION - ALLEY VACATION: 1ST <br />N/S ALLEY EAST OF EDDY STREET <br />It was noted that the Board held a Public Hearing on this <br />proposed alley vacation on April 8, 1986, and at that time <br />continued the matter until this date. Therefore, upon a motion <br />made by Mr. Leszczynski, seconded by Ms. Barnard and carried, the <br />Public Hearing regarding the above referred to proposed alley <br />vacation was re -opened. <br />Mr. John Sullivan, 1118 Wayne Street, South Bend, Indiana, <br />Petitioner, was present and reiterated his comments of April 8, <br />1986, that the alley vacation is requested to insure the safety <br />of the children in the neighborhood. He further advised that <br />there does appear to be a problem with trash trucks having <br />adequate turning movements should this alley be vacated and <br />indicated that the trucks cannot make the turn either north or <br />south. He further advised that the Bureau of Solid Waste did <br />conduct the test to determine whether the trucks had adequate <br />property for turning. The test revealed that they cannot turn in <br />the alley without utilizing a portion of Mr. Sullivan's property <br />and should the alley be vacated and he erect a fence, the trucks <br />would not be able to turn at all. Mr. Sullivan asked members of <br />the Board to favorably recommend that this alley be vacated. <br />There being no one else present wishing to speak either for or <br />against the above referred to proposed alley vacation, upon a <br />motion made by Mr. Leszczynski, seconded by Ms. Barnard and <br />carried, the Public Hearing on this matter was closed. <br />Mr. Leszczynski inquired of Mr. Sullivan whether or not his offer <br />to dedicate additional property to the City needed for safe <br />turning movements for trash trucks was still valid. Mr. Sullivan <br />replied that if that is what is required to close the alley, he <br />would dedicate the needed property. <br />Mr. Leszczynski stated that the trash trucks must be able to go <br />down the east/west alley and turn south and thereforeproperty <br />will be needed in order for the trucks to be able to turn. He <br />further stated that the Bureau of Solid Waste did communicate <br />with the Board regarding problems the trash trucks would <br />encounter should the above referred to alley be vacated. As <br />there are approximately thirty (30) customers on that block, <br />trash trucks must be able to maneuver the turn in the alley. <br />Ms. Barnard reminded Mr. <br />April 8, 1986, he stated <br />safe turning movement for <br />Mr. Sullivan advised that <br />needed property. <br />Sullivan that at the Public Hearing on <br />that he would dedicate property for a <br />trash trucks if that was necessary. <br />he has no problem with dedicating the <br />Ms. Barnard further advised that she spoke to the principal of <br />Jefferson School, 528 South Eddy Street, and he indicated that he <br />is in favor of the alley being vacated. Ms. Barnard further <br />stated that both the Police Department and Fire Department have <br />
