67 <br />REGULAR MEETING <br />MARCH 4, 1986 <br />Mr. Robert D. Lee, Attorney for Petitioner, 502'First Bank <br />Building, South Bend, Indiana, was present and advised the Board <br />that NIPSCO has plans for the overall expansion of its facilities <br />located at Pennsylvania and Miami Streets. He stated that the <br />existing buildings have been there since the 1900's and NIPSCO's <br />overall plan is to expand those facilities. He noted that NIPSCO <br />occupies property on both sides of Pennsylvania Street. Due to <br />past problems in the area of passing machinery and security, it <br />is their desire to contain the basic facility and therefore <br />requests the Board's favorable recommendation for the above <br />referred to vacations. <br />There being no one else present wishing to speak either for or <br />against the proposed alley vacation, and no written objections <br />having been filed with the Board, upon a motion made by Mr. <br />Leszczynski, seconded by Mr. Vance and carried, the Public <br />Hearing on this matter was closed. <br />Mr. Leszczynski advised that based on recommendations submitted <br />by various City departments, it is recommended that NIPSCO <br />construct a cul-de-sac at the east end of Pennsylvania Street at <br />the point where it will dead-end as well as providing some <br />additional property for access off the alley to be vacated. Mr. <br />Lee stated that he has no objections to that request at this <br />time. <br />In response to Ms. Barnard's question regarding the use of the <br />current parking lot, Mr. Lee stated that it would remain a <br />parking lot. He additionally advised that no fencing would be <br />erected and the property could be utilized by residents of the <br />area if needed to turn around. <br />Mr. Lee additionally advised that should the alley be vacated as <br />requested, a dead-end alley would be created. However, as part <br />of the overall plan, NIPSCO would provide ingress and egress so a <br />dead-end alley would not be created thus providing access for <br />residents and trash trucks. <br />Therefore, upon a motion made by Mr. Vance, seconded by Ms. <br />Barnard and carried, the Clerk was instructed to forward to the <br />Common Council a favorable recommendation regarding the vacation <br />of the above referred to street and alleys subject to <br />construction of a cul-de-sac at the east end of Pennsylvania <br />Street at the point where it will dead-end and with the closing <br />of that portion of the north/south alley, dedication of <br />right-of-way for a new east/west alley in order to provide for <br />safe traffic movements and subject to any and all utility <br />easements. <br />OPENING AND AWARD OF BIDS - SALE OF ABANDONED VEHICLES <br />This was the date set for the receiving and opening of sealed <br />bids for the sale of approximately twenty-six (26) abandoned <br />vehicles which have been stored at Steve and Gene's Auto & Truck <br />Salvage and Repair, 3109 South Gertrude Street, South Bend, <br />Indiana. The Clerk tendered proofs of publication of Notice in <br />the South Bend Tribune and the Tri-County News which were found <br />to be sufficient.
