Ct)lo <br />REGULAR MEETING <br />DECEMBER 15, 1987 <br />The regular meeting of the Board of <br />9:31 a.m. on Tuesday, December 15, <br />Leszczynski, with Mr. Leszczynski, <br />and Mr. Michael L. Vance present. <br />City Attorney Thomas Bodnar. <br />Public Works was convened at <br />1987, by President John E. <br />Mrs. Patricia E. DeClercq <br />Also present was Chief Deputy <br />AGENDA ITEM ADDED <br />Upon a motion made by Mr. Leszczynski, seconded by Mr. Vance and <br />carried, an amended Irrevocable Letter of Credit for Cross Creek, <br />Inc. was added to the agenda. <br />APPROVE MINUTES OF PREVIOUS MEETING <br />Upon a motion made by Mrs. DeClercq, seconded by Mr. Vance, and <br />carried, the minutes of the December 8, 1987, regular meeting of <br />the Board were approved. <br />PUBLIC HEARING AND WITHDRAWAL OF PETITION - ALLEY VACATION: 1ST <br />E/W ALLEY S. OF VINE ST. RUNNING FROM 31ST ST. W. TO THE <br />INTERSECTING N/S ALLEY <br />Mr. Leszczynski advised that this was the date set for the <br />Board's Public Hearing on a proposed alley vacation described as <br />follows: <br />The first east/west alley south of Vine, running <br />from Thirty -First Street west to the intersecting <br />north/south alley, for a total distance of 165' <br />more or less all being a part of Eggleston's 1st <br />Addition within the City of South Bend, St. Joseph <br />County, Indiana. <br />It was noted that this Public Hearing is being held in order for <br />the Board to submit a recommendation to the Common Council <br />concerning the Vacation Petition filed by Ms. Beverlie J. Beck, <br />1630 East Randolph, South Bend, Indiana, as Contact Person for <br />the Petitioners, Mark and Beverly Banfy, 1101 South 31st Street <br />and Faye Scherer, 1023 South 31st Street. It was further noted <br />that pursuant to South Bend Municipal Code Section 18-53.8, <br />owners whose property abut the proposed alley to be vacated as <br />well as property owners within three hundred (300) feet of the <br />alley to be vacated were notified of the Board's Public Hearing <br />date. <br />Mr. Arthur Weller, 1013 S. 31st Street, South Bend, Indiana, was <br />present and advised the Board that he is opposed to the vacation <br />of this alley as it would cause a hardship for him. <br />Mr. Walter A. Hill, 1107 S. 31st Street, South Bend, Indiana, was <br />also present and advised the Board that the Hawn's, 1102 S. 30th <br />Street, South Bend, Indiana, will be using the south end of the <br />alley to travel back and forth like they do now and they should <br />use their own alley. <br />Mr. Weller questioned the accuracy of the map submitted with the <br />Petition and indicated that on the north one-half of the block <br />there are six (6) houses but only four (4) lots indicated. After <br />discussion regarding this matter, Mr. Leszczynski assured Mr. <br />Weller that the map submitted with the Petition was accurate. <br />Mrs. Joan Weller, 1013 S. 31st Street, South Bend, Indiana, <br />inquired of the Board the purpose of this proposed vacation. Mr. <br />Leszczynski read from the ordinance submitted with the Petition <br />and advised Mrs. Weller that the purpose was to stop the flow of <br />traffic as cars utilizing the alley currently encroach on <br />adjoining property and the alley is used as a cut -through. Mr. <br />Leszczynski further advised Mrs. Weller that the other side of <br />the alley has been closed pursuant to a vacation petition <br />approved by the Common Council on November 9, 1987. <br />
