REGULAR MEETING <br />SEPTEMBER 29, 1987 <br />Street 148.84 feet; thence North 00°27'00" West, 186.00 feet; <br />thence North 89°3934" East, 165.61 feet; thence <br />Southwesterly 186.99 feet along a segment of a curve to the <br />right having a radius of 912.43 feet, subtended by a chord <br />having a bearing of South 04°42'19" West and a length of <br />186.66 feet to the point of beginning; <br />and <br />WHEREAS, the Commission has evaluated current and anticipat- <br />ed land usage and associated parking needs in the South Bend <br />Central Development Area and has determined that the highest and <br />best use of the above described real property is for the <br />development of a parking facility consisting of approximately 440 <br />parking spaces; and <br />WHEREAS, the South Bend Board of Public Works (Board) is the <br />body charged with the construction of buildings and other <br />structures needed for public purposes, and, particularly, for <br />parking facilities; and <br />WHEREAS, the Board has adopted Resolution No. 24-1987 at its <br />September 15, 1987, meeting determining the need to construct a <br />parking facility of approximately 440 parking spaces at the <br />northwest corner of South St. Joseph Street and East Wayne Street <br />in the City of South Bend; and <br />WHEREAS, at its September 14, 1987 meeting, the South Bend <br />Common Council approved the use of the above described property <br />for a parking facility by Resolution No. 1533-87; and <br />WHEREAS, after notice and public hearing, the Board adopted <br />Resolution No. 27-1987 confirming Resolution No. 24-1987; and <br />WHEREAS, I.C. 36-1-11-8 provides that governmental entities <br />may transfer or exchange property upon terms and conditions <br />mutually agreed upon and for any amount of consideration as <br />agreed upon, pursuant to the adoption of substantially identical <br />resolutions by each entity. <br />NOW, THEREFORE, BE IT RESOLVED by the South Bend Board of <br />Public Works and the South Bend Redevelopment Commission, as <br />follows: <br />Section 1. The South Bend Redevelopment Commission agrees to <br />convey by quit -claim deed to the South Bend Board of Public Works <br />the following described real property located in St. Joseph <br />County, Indiana, for use by the South Bend Board of Public Works <br />for construction and maintenance of a parking garage containing <br />approximately 440 parking spaces, with construction to begin in <br />early 1988: <br />A part of the Northwest Quarter of Section 12, Township 37 <br />North, Range 2 East of the Second Principal Meridian, Portage <br />Township, City of South Bend, Indiana being a part of Lots <br />Fifty (50), and Fifty-one (51) and Fifty-two (52) of the <br />Original Plat of South Bend, Indiana more particularly <br />described as follows: Beginning at the intersection of the <br />Westerly right-of-way line of St. Joseph Street (85 foot <br />right-of-way) with the North right-of-way line of Wayne <br />Street (82.5 foot right-of-way), thence South 89°38'12" West <br />(bearing assumed) along the North right-of-way line of Wayne <br />Street 148.84 feet; thence North 00°27'00" West, 186.00 feet; <br />thence North 89°39'34" East, 165.61 feet; thence South- <br />westerly 186.99 feet along a segment of a curve to the right <br />having a radius of 912.43 feet, subtended by a chord having a <br />bearing of South 04°42'19" West and a length of 186.66 feet <br />to the point of beginning. <br />
