e'0 <br />REGULAR MEETING <br />SEPTEMBER 29, 1987 <br />WHEREAS, the Board held a public hearing at its September 29, <br />1987, meeting at 9:30 a.m., 1308 County -City Building, 227 W. <br />Jefferson Boulevard, South Bend, Indiana, 46601, and heard all <br />persons interested in or affected by the proceedings described in <br />the Resolution; and <br />WHEREAS, the Board received zero (0) written remonstrances or <br />objections prior to 9:30 a.m., September 29, 1987, and has <br />considered those written remonstrances and objections. <br />NOW, THEREFORE, BE IT RESOLVED by the South Bend Board of <br />Public Works, as follows: <br />Section 1. The Board hereby determines that the acquisition, <br />improvements, and works of construction described in the <br />Resolution are of public utility and benefit for and to the City <br />of South Bend and its citizens. <br />Section 2. The Resolution is in all respects confirmed. <br />Adopted this 29th day of September, 1987, at a regular <br />meeting of the South Bend Board of Public Works. <br />SOUTH BEND BOARD OF PUBLIC WORKS <br />s/John E. Parmerlee <br />Mr. Hunt additionally advised the Board that Resolution No. <br />28-1987 submitted to them for adoption ties the City into <br />building the garage. The Redevelopment Commission, at their last <br />meeting, conveyed property to the City for construction of the <br />garage as outlined. The Resolution indicates that the City <br />accepts the property and agrees to move ahead with the project. <br />Upon a motion made by Mr. Vance, seconded by Mrs. DeClercq and <br />carried, the following Resolution No. 28-1987 was adopted: <br />RESOLUTION NO. 28-1987 <br />OF THE BOARD OF PUBLIC WORKS <br />AND <br />RESOLUTION NO. 811 <br />OF THE SOUTH BEND REDEVELOPMENT COMMISSION <br />A JOINT RESOLUTION OF THE SOUTH BEND BOARD OF PUBLIC WORKS <br />AND THE SOUTH BEND REDEVELOPMENT COMMISSION AGREEING TO THE <br />CONVEYANCE AND ACCEPTANCE OF CERTAIN REAL PROPERTY. <br />WHEREAS, the South Bend Redevelopment Commission (Commission) <br />holds title in fee simple to certain real property located at the <br />northwest corner of South St. Joseph Street and East Wayne Street <br />in the South Bend Central Development Area, more particularly <br />described as follows: <br />A part of the Northwest Quarter of Section 12, Township 37 <br />North, Range 2 East of the Second Principal Meridian, Portage <br />Township, City of South Bend, Indiana being a part of Lots <br />Fifty (50), and Fifty-one (51) and Fifty-two (52) of the <br />Original Plat of South Bend, Indiana more particularly <br />described as follows: Beginning at the intersection of the <br />Westerly right-of-way line of St. Joseph Street (85 foot <br />right-of-way) with the North right-of-way line of Wayne <br />Street (82.5 foot right-of-way), thence South 89°38'12" West <br />(bearing assumed) along the North right-of-way line of Wayne <br />1 <br />1 <br />
