e'0 REGULAR MEETING SEPTEMBER 29, 1987 WHEREAS, the Board held a public hearing at its September 29, 1987, meeting at 9:30 a.m., 1308 County -City Building, 227 W. Jefferson Boulevard, South Bend, Indiana, 46601, and heard all persons interested in or affected by the proceedings described in the Resolution; and WHEREAS, the Board received zero (0) written remonstrances or objections prior to 9:30 a.m., September 29, 1987, and has considered those written remonstrances and objections. NOW, THEREFORE, BE IT RESOLVED by the South Bend Board of Public Works, as follows: Section 1. The Board hereby determines that the acquisition, improvements, and works of construction described in the Resolution are of public utility and benefit for and to the City of South Bend and its citizens. Section 2. The Resolution is in all respects confirmed. Adopted this 29th day of September, 1987, at a regular meeting of the South Bend Board of Public Works. Parmerlee Mr. Hunt additionally advised the Board that Resolution No. 28-1987 submitted to them for adoption ties the City into building the garage. The Redevelopment Commission, at their last meeting, conveyed property to the City for construction of the garage as outlined. The Resolution indicates that the City accepts the property and agrees to move ahead with the project. Upon a motion made by Mr. Vance, seconded by Mrs. DeClercq and carried, the following Resolution No. 28-1987 was adopted: RESOLUTION NO. 28-1987 OF THE BOARD OF PUBLIC WORKS AND RESOLUTION NO. 811 OF THE SOUTH BEND REDEVELOPMENT COMMISSION A JOINT RESOLUTION OF THE SOUTH BEND BOARD OF PUBLIC WORKS AND THE SOUTH BEND REDEVELOPMENT COMMISSION AGREEING TO THE CONVEYANCE AND ACCEPTANCE OF CERTAIN REAL PROPERTY. WHEREAS, the South Bend Redevelopment Commission (Commission) holds title in fee simple to certain real property located at the northwest corner of South St. Joseph Street and East Wayne Street in the South Bend Central Development Area, more particularly described as follows: A part of the Northwest Quarter of Section 12, Township 37 North, Range 2 East of the Second Principal Meridian, Portage Township, City of South Bend, Indiana being a part of Lots Fifty (50), and Fifty-one (51) and Fifty-two (52) of the Original Plat of South Bend, Indiana more particularly described as follows: Beginning at the intersection of the Westerly right-of-way line of St. Joseph Street (85 foot right-of-way) with the North right-of-way line of Wayne Street (82.5 foot right-of-way), thence South 89°38'12" West (bearing assumed) along the North right-of-way line of Wayne 1 1
